Africa-Press – Angola. Deputies to the National Assembly (AN) defended this Tuesday (7), in particular, the application of the maximum penalty for crimes of sexual rape of minors.
This position was expressed during the debate on the proposal to amend the Penal Code, which establishes a criminal framework of 3 to 12 years in prison for crimes of sexual rape.
Parliamentarians state that the measure constitutes a fundamental step in materializing the commitment to establish a criminal policy and reform of criminal justice, which includes responses to large, medium and small crimes.
During the discussions, the deputies also proposed changing the wording of the article related to the criminal framework regarding sexual abuse, which states that “anyone who, being an adult, performs a sexual act with a minor, for payment or other consideration, is punished with a prison sentence from 6 months to 3 years”, when this should be from 3 to 12 years.
They also mention that the sexual abuse of a dependent minor has, in relation to the base crime of abuse of minors, a relationship of specialty and degree/qualification, therefore, they defend the need to ensure the differentiation of the level of responsibility of the agents, taking in particular pay attention to this aspect.
The proposal to amend the Penal Code is an initiative of the head of State and falls within the scope of the process of reviewing legislation in the Justice sector, with a view to updating the legal-constitutional reality and implementing the fundamental rights and freedoms of established citizens in the Constitution.
This proposal proposes to introduce a specific body of changes to several articles of the Angolan Penal Code, approved by Law no 38/20, of 11 November.
