Africa-Press – Angola. <\/strong><\/span>The hearing was marked by the observation of preliminary questions, at which time the lawyers took the opportunity to request the presence of senior State officials to help clarify matters related to the condition of some defendants.<\/b><\/p>\n

The first day of the trial of the so-called “Lussati case”, resulting from the Caranguejo operation, conducted by the PGR, was marked, yesterday, by the preliminary questions, where the lawyers began to put into practice the strategy to conduct the process in favor of their constituents, and they were confident.<\/p>\n

Under the Criminal Procedural Law, lawyers present to the court those questions that may prevent the merits of the case from being heard. Lawyer Jorge Golfo Afonso, who represents the defendant Joaquim Jos\u00e9 Armando, was the most controversial for taking more than an hour to present several questions, having “infuriated” the judge.<\/p>\n

On several occasions the presiding judge of the case had to stop the lawyer and clarify that it was necessary to be concise and take into account the high number of lawyers involved in the process, given that they are over 40. The attitude of lawyer Jorge Golfo Afonso left the audience angry, who asked the lawyer in unison to stop. The presiding judge used his sovereign power to interrupt the hearing, obtaining a break of one hour.<\/p>\n

However, tried to hear lawyer Jorge Golfo Afonso, but he said he was not in a position to make statements to the press. The same showed strong emotions, since he was visibly trembling. The hearing, which began in the morning, continued into the night.<\/p>\n

The “Lussati case” follows the implementation of the policy to combat corruption and mismanagement of public affairs, by the President of the Republic, Jo\u00e3o Louren\u00e7o, since 2017, when he assumed the leadership of the Angolan State.<\/p>\n

Presence Of Declarants<\/b><\/p>\n

Anast\u00e1cia de Melo, Pedro Mulhongo’s lawyer, explained that she requested the presence of the current Minister of State and head of the Civil House of the President of the Republic, Ad\u00e3o de Almeida, just because he was present during the period when the salaries of the staff assigned to the House of Security of the President of the Republic. The idea, she clarified, is to understand with the help of the Minister of State why her client does not receive his wages to date, despite his accounts being unblocked. She made it known that the situation is worsened by the fact that her constituent is a “free defendant” and is working.<\/p>\n

“The families are going through serious needs”, emphasized the lawyer. The defenders justified that the presence of the former holders of the Ministry of Finance, as well as that of the current minister Vera Daves, is purely and simply due to the fact that the institution is responsible for managing public revenues and expenditures. In this order, the presence of the president of the Court of Auditors, Exalgina Gamboa, is also justified, as the institution she directs has the mission of inspecting the State’s accounts.<\/p>\n

During the preliminary questions exercise, it became clear that the appeal, by request, of senior public office holders responds to the need to clarify situations surrounding the process, but which are outside the procedural scope directly linked to the matter under trial. The legal nature, in substance, as to what is under judgment, does not refer to the figures summoned in the condition of declarants.<\/p>\n

The defense lawyers intend, therefore, with the presence in the trial of high figures, to resolve previous points, to move forward with the issues directly related to the process at trial. For this purpose, the former Minister of State and head of the Security House of the President of the Republic, Pedro Sebasti\u00e3o, the President of the Court of Auditors, Exalgina Gamboa, the Minister of State and Head of the Civil House of the President of the Republic, Ad\u00e3o, were requested. de Almeida, of the former Ministers of Finance, since 2008, namely Pedro de Morais, Carlos Alberto Lopes, Armando Manuel, Archer Mangueira and the current Minister of Finance, Vera Daves.<\/p>\n

They pointed out, in the allegations, that the former and current high-ranking State officials listed, despite not being linked to the process, are in a position to clarify certain situations. With the same perspective, the Main Directorate of Personnel and Staff of the FAA was also requested to add to the report of the Executive ALFA group of in-person registration and collection of biometric data at the Military House of the President of the Republic.<\/p>\n

The presentation of preliminary questions was marked by moments of tension between lawyers and the jury led by judge Andrade da Silva.<\/p>\n

J\u00falio Laurindo Chongolola is another citizen who was at the CCT, having recognized that the beginning of the trial of the “Lussati case” was long awaited by society. “For what is our expectation as citizens, there will be a lot that will be discovered during this trial session, and we hope that everything goes according to the law”, he underlined.<\/p>\n

Angolan society expects legality to be restored. In fact, it is a very large sum, and this is to discourage those citizens who, when they are appointed to public office, are discouraged from engaging in this practice,” he said.<\/p>\n

Lawyers Yuri Pascoal and Osvaldo Carlos Salupune understand that the Public Prosecutor’s Office committed several irregularities in the preparatory investigation phase, and that is why the preliminary questions phase, operated in the trial session, is taking a long time.<\/p>\n

Defendants Pedro Lussati, Fernando Mois\u00e9s Dumbo and 47 other elements are accused of crimes of embezzlement, criminal association, undue receipt of advantages, economic participation in business and abuse of power.<\/p>\n

The defendants are also accused of fraud in the transport or transfer of currency abroad, illicit introduction of foreign currency into the national market, illegal currency trading, prohibition of cash payments, currency retention, forgery of documents, money laundering. and assumption or attribution of false identity.<\/p>\n

The 49 defendants and their legal representatives appeared yesterday at the Talatona Convention Center (CCT), in an atmosphere of calm and tranquility. The parties listed a number of witnesses, numbering over 200 people. Due to limited space for the trial, the courtroom of the Criminal Section of the Luanda District Court – Pal\u00e1cio D. Ana Joaquina, was appointed to the Talatona Convention Center to hold public hearings.<\/p>\n

Presence Of Relatives<\/b><\/p>\n

Several people, including relatives and friends of the accused, came to the Talatona Conference Center (CCT) to attend the first day of the trial of the “Lussati case”. There was room for everyone. Upon arrival, people were rigorously searched and taken to the courtroom, located in the main hall of the CCT.<\/p>\n

Journalists had a reserved place outside the room, but only journalists were allowed in, as the image reporters were prevented, as they were not authorized to capture images of the audience.<\/p>\n

Adelaide Ana da Silva, who attended the first day of hearings, is the godmother of the defendant Ant\u00f3nio Marques. She said it is the first time she has attended a trial, and she felt a sensation she had never felt before. “They said it would start at 9 am, but it started really late and it’s been a little exhausted,” she stressed.<\/p>\n

“Let’s see how it ends. It’s been a unique experience, it’s a very relevant case in society, let’s see what happens”, he stressed, having mentioned that when he saw Lussati’s image for the first time, “what what happened was frightening, especially the large bags of money”.<\/p>\n
