The president of the CNE, Manuel Pereira da Silva, guided the work of the meeting.<\/b><\/p>\n<p>UNITA, the Nationalist Party for Justice in Angola (P-JANGO), the Angolan Humanist Party (PHA) and the CASA-CE coalition delivered, on Wednesday (7), to the Constitutional Court the documents necessary to correct the shortcomings detected in the cases. of candidacies, thus marking the end of the period foreseen by Law for the correction of irregularities.<\/p>\n<p>After the supply period, counting from the publication of the initial lists, period observed from June 26th to July 5th, the phase of evaluation and appreciation, by the plenary of the Constitutional Court, follows the verification of the authenticity of the documents submitted by the parties and the political coalition.<\/p>\n<p>The judges meet and, within a short period of 48 hours, must decide on the admission or rejection of applications. As for the decision of the plenary of the TC, the Law also gives the possibility for political forces to file a complaint. After this possibility, in the event of insufficiency in the lists, the decision of the plenary regarding the complaint will no longer be subject to appeal.<\/p>\n<p>The director of the Office of Political Parties of the Constitutional Court, Mauro Alexandre, warned, by the way, that, later, it is not subject to appeal because the deadlines in electoral processes are too short. &#8220;Having the Constitutional Court received the contestation of the list that was not admitted, it has to decide within 48 hours, after this, the Law guides the final disclosure of the lists. Of the two lists, one is sent directly to the National Electoral Commission, and a second that is posted at the Constitutional Court&#8221;, he explained.<\/p>\n<p>The TC&#8217;s initial intervention phase ends, roughly, between the 15th and 16th of this month, when the process will be sent to the CNE. At this point, he continued, the Constitutional will function in the guise of an Electoral Court and will be called in later stages, that is, after the publication of the final electoral results by the National Electoral Commission.<\/p>\n<p>He referred that there may always be situations of contestation of electoral results, which are resolved by the Constitutional Court in the capacity of the Electoral Court and, therefore, at the end of this entire chain, it is the responsibility of the TC to validate or not the elections.<\/p>\n<p>At the time, when asked about the legal tools that will be used to challenge, Mauro Alexandre clarified that this is an experiment.<\/p>\n<p>Reserved for political parties: &#8220;If a political party understands that there are enough elements for this purpose, it is not up to us to raise these questions, otherwise we will create unnecessary noise&#8221;, he observed, adding: &#8220;But if a party , for reasons of a technical and legal point of view, that there are elements in the other candidacy that can be questioned and contested, that party is free to do so, because the law allows&#8221;.<\/p>\n<p>The Constitutional Court, he said, will be responsible for analyzing the arguments of the party that is challenging the other to assess or not from a technical and legal point of view. After the assessment and decision of the TC plenary, the party that challenged the other candidacy is notified of the decision. From a legal point of view, he reinforced, the representative of the contested list also has the opportunity to defend himself.<\/p>\n<p><b>Constitutional without registration of contestation of candidacy<\/b><\/p>\n<p>Last Monday, the president of the Constitutional Court, Laurinda Cardoso, said that the institution she directs has not received any challenge to the candidates of the parties that compete in the General Elections on 24 August. &#8220;The deadline for contesting any list or candidate ended without any objections having been presented&#8221;, informed Laurinda Cardoso, quoted by Lusa.<\/p>\n<p>The posting of the lists aims to provide the legal possibility for candidacies to be challenged, which can be done by any party or interested party that verifies the ineligibility of a candidate or other irregularities.<\/p>\n<p>The initial lists were posted on the 26th of June and the candidacies could be challenged within 72 hours, which ended at the end of the 30th of June. The Constitutional Court is involved in several stages of the electoral process, namely in the reception and validation of candidacies from parties and coalitions of political parties.<\/p>\n<p>Representatives are comfortable with the progress of the process<\/p>\n<p>For some political parties, the delay in obtaining the documents, after they had been requested from the municipal administrations, was the basis for the delivery of the corrected processes on the deadline.<\/p>\n<p>According to UNITA&#8217;s representative, David Hor\u00e1cio Njunjuvile, the shortcomings detected in UNITA&#8217;s candidacy were related to the lack of mention of the purpose in the Criminal Record certificates and the absence of one or another seal in the declarations. During the notarial acts for the recognition of documents, seals were omitted and illegible copies of Identity Card were detected.<\/p>\n<p>UNITA was notified following the submission of the application process, where 33 shortcomings were identified in the entire process at the time. &#8220;Attentive to what was set out in this order, we came to deliver the documents in the form required by law,&#8221; said the representative.<\/p>\n<p>&#8220;We proceeded with the delivery, and now we will wait, calmly, for the Court&#8217;s decision, so that we can all embark on the subsequent steps defined by law&#8221;.<\/p>\n<p>The representative of CASA-CE, Carlos Mateus Jacinto, told our report that the coalition was again notified last Monday, after they had delivered the documents for supply. &#8220;That&#8217;s why we came to fulfill this obligation, presenting the legal documentation of some candidates.
