Viana, Cazenga and Kilamba-Kiaxi are the municipalities in Luanda with the highest number of reported cases of missing persons. For the coordinator of the SOS Disappeared in Angola association, Catanha Chilela, it is essential that parents and guardians pay special attention to their children, especially girls, aged between 13 and 25, as they are the age group with the highest incidence of cases. .<\/p>\n

Today, he said, the 30th of August, the International Day of Victims of Enforced Disappearance is celebrated around the world and the date should serve as a warning to parents about the risks to which many of their children are subject. “This practice, sometimes and in most cases, tends to end tragically. It is necessary to reverse the situation”, she said.<\/p>\n

The event, he said, should not be summarized simply to people forced to prison, but also to reflect on the situation of those who disappear, due to mistakes on the Internet, and end up being abused, or killed.<\/p>\n

Catanha Chilela believes that the problem can be better resolved with the support of families. “Generally, we should consider any disappearance, whether long or not, of a family member to be anomalous. It is necessary to report it to the authorities immediately, so that the intervention is swift”.<\/p>\n

Almost always, he continued, it is the lack of attention to certain behaviors of the children, which leads to situations of this kind. “There are children who leave without giving satisfaction to where they are going and the practice is inadvisable”, he said, in addition to asking for a faster response from all those involved in solving these cases. , a department specializing in missing persons\u201d.<\/p>\n

Currently, he said, the association SOS Disappeared in Angola has been monitoring some cases of people in captivity, according to family reports. \u201cUsually, alerts come very late, but we did everything we could to help,\u201d he says, adding that some of the families they are working with at the moment say they are distressed. \u201cThe response to investigations has been slow. Incidence and prevention<\/b><\/p>\n

Among the country’s provinces, Luanda, most notably, Benguela and Hu\u00edla are the ones with the highest number of missing persons occurrences. “Since February 2020 we have already received 243 cases of missing persons, of which 16 resulted in deaths. But to date, we have helped to solve 175 cases”, he said.<\/p>\n

Combating this practice, he continued, is also a way of stopping human and organ trafficking. “Although in Angola cases of this kind are not very pronounced, there must be policies to encourage prevention”.<\/p>\n

Catanha Chilela asks women a lot of attention, particularly in contact with strangers, with emphasis on acquaintances on social networks. “The alert is for everyone, but with greater focus on women and children,” she said.<\/p>\n

Almost always, he explained, the profile of victims falls on people between 13 and 35 years old. “Of course, forced disappearance has no set age. Some victims are people observed by criminals for days before the action and can be up to 50 years old or more. The association, he said, has been working with collaborators on social networks, for greater dissemination of information on the cases, as well as with the Criminal Investigation Service (SIC), the National Police and the population. “The first contact is always made with the victim’s family”.<\/p>\n

Criminal liability for anyone who simulates a kidnapping<\/b><\/p>\n

Due to the consequences of the forced disappearance of people, lawyer Arcangela Zaide warns anyone who tries to simulate a kidnapping to be careful, as the penalty is 2 to 12 years in prison, depending on the severity.<\/p>\n

“The penal framework for this type of crime is from 2 to 8 years in prison, which can be increased to 12, if the kidnapping simulation lasts more than 30 days. For a disappearance to be considered as such, it is enough, according to the subparagraph d) of paragraph 1 of article 174 of the Angolan Penal Code (CPA), that the complaint be made, by any citizen, to the authorities\u201d, he explained.<\/p>\n

In terms of Angolan criminal law, he explained, kidnapping is one of the types of crime against people’s freedom, to the point that even simulation is punishable. “The simple notification of the case to the police authorities, or the optional denunciation by any citizen, already implies the crime, so whoever simulates it can be punished”.<\/p>\n

In these cases, he adds, even after its appearance, the person must be held responsible, for the execution of the crime and the consummation of it, for an adequate conduct of constitutive elements of a type of crime, foreseen and punishable by the Penal Code.<\/p>\n

“The prison sentence applied to the offender has the purpose of protecting the legal good of the community, postponed by the Angolan Constitution, and helping to reintegrate the person into society, as a way of also discouraging him from future behavior, as well as limiting attitudes similar parts of other citizens\u201d, he added.<\/p>\n

The head of the Institutional Communication and Press Office of the Criminal Investigation Service (SIC) Luanda, Fernando Carvalho, considers the forced disappearance of people a crime, which must be fought at all costs, so as not to become a dangerous practice. .<\/p>\n
