Africa-Press – Angola. <\/strong><\/span>The re-elected President of the Republic and the MPLA, Jo\u00e3o Louren\u00e7o, commented this Sunday, on social media, that he is calmly awaiting the decision of the Constitutional Court, at a time when the party he led was declared by the National Electoral Commission the winner of the election on 24 December. August, with 51.17 percent against 43.95 for UNITA, the biggest opposition party.<\/b><\/p>\n

On his official Twitter page, Jo\u00e3o Louren\u00e7o wrote that “the MPLA took to the streets yesterday (Saturday) to celebrate the victory of the penta”, based on the results of the General Elections of August 24, which so far guarantee 124 seats in the National Assembly, 34 more than the “black rooster” party (90).<\/p>\n

“We wait serenely for the decision of the Constitutional Court. Then we will organize the second party, the investiture ceremony and the following acts. Angolans, we are together”, he underlined in last Sunday’s post.<\/p>\n

In another post, just yesterday, on the social network Facebook, Jo\u00e3o Louren\u00e7o invited everyone to enjoy the Sunday with “bright, cheerful sun”, so that they could “regain energy and good mood for the work week that (today) begins”.<\/p>\n

According to the President of the Republic who was re-elected in the last election on 24 August, there is much to be done for the country that everyone loves and that always comes first: “I wish you all good health. The National Electoral Commission (CNE) declared Jo\u00e3o Louren\u00e7o as President of the Republic and Esperan\u00e7a da Costa as Vice-President of the Republic, after releasing the final results of the General Elections of 24 August, which confirmed the MPLA as the winning party, with 3,209,429 votes, corresponding to 51.17 percent of the valid votes.<\/p>\n

Electoral Court<\/b><\/p>\n

Last Friday, 2 September, the Constitutional Court clarified, in Luanda, when assuming, for the first time, the guise of an Electoral Court, that it did not receive any request for annulment of the General Elections of 24 August, as the UNITA, cited by the international press.<\/p>\n

Mauro Alexandre, director of the Office of Political Parties of the Constitutional Court, highlighted, by the way, that the institution received only two requests filed by UNITA and CASA-CE, whose contents “cannot be shared, for the time being, because deal with very preliminary information, which has not yet been the subject of appreciation”.<\/p>\n

The official made these clarifications during the briefing with journalists, after being questioned, where the news from the Lusa agency was listed, which, citing a source close to the UNITA board, advanced the information that the largest opposition party filed, in the Constitutional Court. , on Thursday, a request for annulment of the General Elections of 24 August.<\/p>\n

He considered it “false that the cancellation of the General Elections had been requested”, after insisting that only two requests had been received by UNITA and CASA-CE. “What we can say is that these applications, naturally, will go through an appraisal process in relation to the procedural formalism that, in essence, is to see if all the presuppositions for their admission are met.”<\/p>\n

Mauro Alexandre assured that the Constitutional Court will henceforth hold meetings with the media, national and foreign, to clarify public opinion on the daily incidences of the processes that come to the institution.<\/p>\n

According to the director of the Office of Political Parties of the Constitutional Court, of the cases that have been filed at the institution, none makes any reference, in terms of requests made, to an annulment of the elections. “None of the processes received (Thursday) requests, in terms of request, any annulment of the electoral process”, he pointed out during the meeting with the press.<\/p>\n

He said that it is premature, and poorly informed, to reveal the concrete content of these complaints, making it clear that, often, “what is conveyed, as requests, is not in accordance with the nature of the electoral dispute itself”.<\/p>\n

As for the possibility of an intervention by international organizations in the Angolan electoral process, as the UNITA leader wishes, in response, the director of the Office of Political Parties of the Constitutional Court, Mauro Alexandre, clarified that the court, in the exercise of jurisdictional power, has competences in legal-constitutional matters of electoral political parties.<\/p>\n

He referred that, in this dimension of the exercise of powers in electoral matters, the Constitutional Court is a body with full jurisdiction: “In other words, the Constitutional Court of the Republic of Angola, having full jurisdiction in electoral matters, its decision is for of verification and validation of the General Elections”.<\/p>\n

He stressed that in a possible direct confrontation between Angolan Internal Law norms and norms resulting from International Law, these questions should, naturally, be the object of a study on the jurisprudential panorama in relation to decisions already produced by the Constitutional Court itself.<\/p>\n

In Mauro Alexandre’s view, despite the fact that it follows from the Angolan Constitution, which is also applicable to Angolan Law, norms of International Law, “however, this application, naturally, can only take place in circumstances that do not jeopardize the sovereignty of the State -from the Angolan”.<\/p>\n

“Before being admitted, the applications have to be verified, if the procedural and formal presuppositions are fulfilled”, he explained, explaining that, when talking about procedural presuppositions, the confirmation of the legitimacy of the person who comes to appeal, the competence of the Constitutional Court to consider these same requests and then analyze them, until the end, what is requested, and if this request arrived within the deadlines determined by law.<\/p>\n

“Having verified the procedural assumptions, it is also important that the application itself undergoes a formal verification, that is, the Law provides that the application must contain reasons in fact and in law”, he highlighted.<\/p>\n

At this moment, he reinforced to journalists, the Constitutional Court is carrying out the verification of all these processes, which will culminate, later, with the admission of the requests filed by CASA-CE and by UNITA, which may, in the end, be admitted or not. .<\/p>\n
