Africa-Press – Angola. <\/strong><\/span>Deputies and members of the Executive agreed, this Monday, that the proposal for an Amnesty Law contemplates sentences of up to eight years in prison, against the ten contained in the legal diploma under discussion, in the specialty, by the National Assembly.<\/b><\/p>\n

The Minister of Justice and Human Rights, Marcy Lopes, recalled that the spirit of the diploma is not to grant amnesty for serious crimes, such as sexual crimes and those that have been committed intentionally and that result in death.<\/p>\n

He pointed out, by the way, that tax offenses are not subject to amnesty under this Law, but are forgivable. “The field of forgiveness of tax crimes does not fit in a law such as amnesty”, he said, adding that it is an act of the State that lacks budgetary and fiscal studies of the Finance, General Tax Administration sectors to determine, above all, whether with the forgiveness of certain tax behaviors by companies, the State will have the budgetary capacity to support the absence of the financial flow subtracted as a result of them (tax infractions).<\/p>\n

Marcy Lopes, who responded to the concerns of the deputies during the discussion, in particular, of the proposed Amnesty Law, was repeatedly questioned by some deputies about the possibility of extending the penal framework, justifying it with the fact that studies they were not made for that purpose.<\/p>\n

“We cannot guarantee the admissibility of this amendment”, said the minister, who in a pedagogical way explained that a penal framework is the boundaries within which a certain conduct qualified as a crime can be judged, qualified and condemned with the minimum or maximum penalties.<\/p>\n

He explained, by the way, that crimes are amnestied, regardless of the procedural stage in which he finds himself. He further clarified that intent is synonymous with will, intention, deliberation, premeditation, while violence is every fact that in the commission of a crime has resulted in the use of violence and force for the commission of the crime.<\/p>\n

Deputy considers “right measure”<\/b><\/p>\n

MPLA MP Lourdes Caposso considered the reduction from ten to eight years the time for citizens to benefit from freedom in the current Amnesty Law proposal, as a “right measure”, in favor of people’s safety.<\/p>\n

“We approved only eight instead of ten years to be careful with those who receive amnesty”, said the deputy rapporteur, for whom keeping the initial ten years would allow a greater number of inmates to leave the cells, when family members often need to prepare, in a convenient way, the conditions to guarantee their social reintegration.<\/p>\n

Yesterday’s debates focused, therefore, on issues that have to do with the social reintegration of prisoners who are granted amnesty. “It’s not enough to withdraw just to remove prisoners from jail. Sometimes it’s safer for them to leave jail with a profession and prepared to be useful to society, given the fact that, currently, prisons have training centers that allow inmates to learn about different professions\u201d, said the parliamentarian.<\/p>\n

Just yesterday, the deputies debated, in some detail, the third article of the proposed Amnesty Law, concerning the issue of pardon. The debate was broad and well attended, given the fact that several paragraphs were included, referring to crimes against the security of the State, embezzlement, sexual, abuse of trust, all of which are not contemplated in the current proposal for the Amnesty Law.<\/p>\n

“Crimes that are not related to blood or sex may be pardoned for a quarter of the sentence, allowing for an increase in the number of amnesty holders”, said Lourdes Caposso, indicating that individuals who have already served up to 1\u20444 of the sentence may be set free, provided that such crimes are not against human life and of a sexual nature.<\/p>\n

The parliamentarians are voting, today, on article three of the proposal, continuing, afterwards, the discussions, in the specialty, of the last three articles of the document. The Amnesty Law is an initiative of the President of the Republic, which proposes amnesty for crimes and at the same time granting pardon for sentences.<\/p>\n
