Africa-Press – Angola. <\/strong><\/span>The political parties National Patriotic Alliance (APN) and Nationalist Party for Justice in Angola (P-NJANGO), participants in the General Elections last August, were officially extinguished, for failing to reach the legally established minimum of 0.5% of the total of valid votes, this Monday, press found out about the judgment of the Constitutional Court, signed by the collective of judges.<\/b><\/p>\n

The document states that, on the 3rd of November of this year, the Attorney General of the Republic, under the Law on Political Parties (LPP), submitted an application to the Constitutional Court for the judicial declaration of the extinction of the two parties, having presented based on the fact that both the APN and P-NJANGO fell short of the required minimum percentage of votes.<\/p>\n

In the same judgment, of the 13th of the current month, the panel of judges, in addition to declaring the parties in question extinct, “with effect from the present date”, “orders the cancellation of the respective registration”, as well as “determines that the competent statutory bodies\u201d of extinct parties \u201cproceed with their liquidation within 90 days\u201d, and the activity of the directorates and other bodies \u201cmust be limited to what is strictly necessary to carry out the liquidation process, as stated in the law\u201d. having reached the legally established percentage, the political party Alianc\u0327a Patriotica Nacional suffers the legal consequence foreseen in paragraph i) of paragraph 9 4 of article 33.9 of the LPP\u201d, reads, still, in the same document, which ends asking the Constitutional Court to , pursuant to paragraph i) of paragraph 4 of article 33.9 of the LPP,declare the extinction of the political party National Patriotic Alliance (APN), led by Quintino Anto\u0301nio Moreira, with the justification being the dissolution of P-NJANGO, headed by Dinho Chingunji.<\/p>\n

On the other hand, the Constitutional Court clarifies, in the same judgment, that the APN party came to the file to fight for the dismissal of the action claiming, in essence, that the norm of paragraph i) of n.9 4 of article 33.9 of the LPP is “unconstitutional \u201d, by imposing as a cause for the extinction of political parties the failure to obtain 0.5% of the total votes cast in elections.<\/p>\n

In view of the above, the Constitutional Court considers that the interpretation of the APN “disregards the rules of normative interpretation that the legislator enshrined in paragraph 91 of article 9 of the Angolan Civil Code”, whose content “determines that the interpretation should not be limited to the letter of the law\u201d, but \u201creconstructing the legislative thought from the texts, taking into account, above all, the unit of the legal system in which the law was elaborated and the specific conditions of the time in which it is applied.<\/p>\n

“From a careful reading of the defendant’s arguments, it appears that he makes an interpretation leaving aside the systematic element of interpretation, that is, he analyzes the legal norm in isolation, ignoring the unity of the legal system”, maintains the Court.<\/p>\n

The dispatch of the judgment also underlines that, in the framework of the contradictory, the P-NJANGO party was summoned on 14 November 2022 to, within a period of ten days, contest the action, which came, on 25 November, to request deadline extension.<\/p>\n

Once the records were compelled, the Court says it verified that there was no evidence in the process that would justify the fair impediment for the defense not to have been presented within the legally established period\u201d. The Court asserts, however, that the deadline for contesting is peremptory, so that “under the terms of the law, its course extinguishes the right to perform a certain act\u201d.<\/p>\n

The Law on Political Parties establishes, the document also reads, that one of the causes for the extinction of a Political Party is the failure, in an electoral process by the Party, alone or in coalition, of at least 0.5% of the votes validly expressed.<\/p>\n

In the General Elections on August 24th of this year, the MPLA won the suffrage with 51.17% of the votes, the APN obtained 0.48% and 30,139 votes, and the P-NJANGO, 0.42% and 26,867, at least that both failed to reach 0.5% of the validated votes.<\/p>\n
