Africa-Press – Angola. <\/strong><\/span>One week after taking office, the guarantees judges of the Moxico District Court have already considered five cases, upon request from the Public Ministry (MP), said this Tuesday, in Luena, the presiding judge of this body, Rivaltino Van-du\u0301nem.<\/p>\n

According to the Judicial Magistrate (MJ), three guarantee judges were appointed to the Moxico District Court, to safeguard the fundamental rights of citizens in conflict with the law.<\/p>\n

He said that in this period, the guarantees judges analyzed five processes, in the preparatory instruction phase, susceptible to the application of the measure of preventive coercion of freedom, after a request from the Public Prosecutor’s Office (MP).<\/p>\n

He added that for this task, judges of law of the said court were appointed, after benefiting from training, to accumulate the functions.<\/p>\n

According to article 313 of the Code of Criminal Procedure, it is incumbent upon the guarantees judge, among others, to apply coercive measures and assess complaints arising from acts of the Public Prosecutor’s Office, may carry out the first judicial interrogation of the detained defendant, order searches in establishments and the seizure of procedurally relevant objects found in searches.<\/p>\n

The province of Moxico, with 223 thousand 23 square kilometres, inhabited by close to one million inhabitants, distributed in nine municipalities, has only one Comarca court, based in the city of Luena.<\/p>\n

On the occasion, the presiding judge said that this fact has caused constraints in the administration of justice, mainly in remote municipalities such as Alto Zambeze, which is 519 kilometers from the city of Luena.<\/p>\n

\u201cWe believe that with the Political-Administrative Division (DPA) project, new courts may emerge,\u201d he said.<\/p>\n
