Africa-Press – Angola. <\/strong><\/span>With a workshop and an international conference on the recovery of assets, as part of the Legality Week, which takes place throughout the country and within the framework of the celebrations of its 43rd anniversary, the PGR highlights, among the lessons of the asset recovery process, initiated for almost four years, which he considers the major premise: \u201cthe crime or the illicit appropriation of public goods is not an acquisitive title of right\u201d.<\/b><\/p>\n

And that encourages us to continue with this fight, which aims to restore legality and continue with efforts to recover assets, returning heritage to the State and to the citizen the feeling of justice and to enjoy the goods that belong to all” , points out the Attorney General of the Republic.<\/p>\n

According to the magistrate, the recovery of assets belonging to the State and acquired illicitly is always based on the observation of legal procedures and\/or the initiation of civil and criminal actions, concomitantly, with a patrimonial investigation that is attached to the main process.<\/p>\n

“About four years ago, we faced the urgent need to combat crimes of an economic and financial nature, in terms of “white collar crimes”, a relatively new reality, in which the Public Ministry had to adapt to the from the point of view of human and material resources, reinforcing its institutional capacity, the training and qualification of magistrates and justice technicians, to face the situation. we continue to improve ourselves to achieve excellence\u201d, he emphasizes.<\/p>\n

Among the difficulties that the PGR faces in the asset recovery process, Helder Pitta Gr\u00f3z points out the geographical aspects of the location of the assets.<\/p>\n

“It is known that the financial resources were taken, mostly, outside our country, which implies a diplomatic and legal effort for their recovery, since the values \u200b\u200band goods ended up integrating and, in some cases, being strategic in the economies of these countries. countries\u201d.<\/p>\n

But he guarantees that everything has been done, based on international, bilateral and multilateral agreements and conventions, to which Angola is a party, with a view to the recovery of movable and immovable assets, located elsewhere, considering the results achieved so far “encouraging”. “However, greater internal and international institutional cooperation is needed with the countries where these goods are located”, he appealed.<\/p>\n

Regarding possible risks that most of the diverted assets cannot be recovered, because they are abroad, the magistrate says that the recovery of assets should not be seen only from the perspective of the return of these assets to the country.<\/p>\n

“It is necessary to emphasize that the recovery of assets does not necessarily involve their return to the country, it is enough that they change ownership, wherever they are located, becoming part of the heritage of the Angolan State”, he said.<\/p>\n

Co-Payment Scheme<\/b><\/p>\n

Questioned about the suspicion that has been raised by some sectors, regarding the system of reimbursement that attributes to the PGR and the Courts 10 percent of the net value of the recovered financial and non-financial assets, as there is a risk of jeopardizing the independence and impartiality of the magistrates, the Attorney General of the Republic clarifies that “this alleged suspicion does not bother the PGR, as it is not only a reality of the Angolan legal system”.<\/p>\n

“This is a practice that is transversal to other legal systems and results from the rules and recommendations of international conventions on the recovery of assets, the co-participation of the authorities that recover them, with a view to creating increasingly better conditions”, he underlines. .<\/p>\n

He adds that if in other countries the “problem” of the legal attribution of this contribution does not arise and does not constitute an obstacle to the transparency and independence of the Judiciary, “for all the more reason, it should not be in Angola”.<\/p>\n

It emphasizes that at the level of the CPLP (Community of Portuguese-Speaking Countries), Angola and Guinea-Bissau are the only countries that receive a 10 percent co-payment of recovered assets, while, in the other member countries of the community, the percentage fluctuates between 40 and 100 percent.<\/p>\n

It also notes the fact that the PGR of Angola was recognized and chosen, at the Meeting of Attorneys General of the Community of Portuguese-Speaking Countries, held in S\u00e3o Tom\u00e9 and Pr\u00edncipe, to coordinate the CPLP Asset Recovery Network, due to its performance in the fight against corruption and recovery of assets illicitly allocated to the State.<\/p>\n
