Africa-Press – Angola. <\/strong><\/span>With the call, by the President of the Republic, of the next general elections for the 24th of August, the current Government enters into day-to-day management on the 24th of July, exactly one month before the voting day.<\/b><\/p>\n

Due to an error of interpretation, in Monday’s edition, we reported that, with the entry into force, this Monday, of the Presidential Decree calling the elections, the Executive entered into day-to-day management from that day onwards, which does not correspond the truth. This will only happen from the 24th of July, when the electoral campaign actually begins, which lasts for a month.<\/p>\n

The basis for this requirement is article 116 -A of the revised Constitution of the Republic, which establishes that “in the period between the electoral campaign and the inauguration of the elected President of the Republic, the current of the executive function, not being able to perform acts that condition or bind the exercise of governmental activity by the elected President of the Republic\u201d.<\/p>\n

The jurist Jo\u00e3o Pinto said, that the day-to-day management of the executive function means not being able to carry out normative, administrative or contract acts that could compromise the future Executive. He clarified that “the day-to-day management of the executive function takes place between the call for elections, electoral campaign and the inauguration of the new President of the Republic or the Government”<\/p>\n

Executive management, according to Jo\u00e3o Pinto, corresponds to the 30-day period of the electoral campaign (Article 116(1) of the Constitution), taking into account the call for elections, which takes place 90 days before the end of the term of office of the President in office and of deputies, according to article 112 of the Constitution.<\/p>\n

He also explained that the acts performed in day-to-day management are limited and apply, equally, to the auxiliaries of the President of the Republic, as expressed in the new article 116-A of the Constitution of the Republic, added by the Constitutional Revision Law n\u00ba 18\/ 21 of the 16th of August.<\/p>\n

Jo\u00e3o Pinto justified the extension of the limitation of acts to the auxiliaries of the President of the Republic, because, in the light of the Constitution, the Angolan Executive is a one-person government.<\/p>\n

The jurist explained further about the day-to-day management of the executive function: “The President of the Republic performs his function in day-to-day management, that is, he cannot compromise the future Executive, and must only govern in twelfths. carry out normative or administrative acts that go beyond the mere current management or what is already in execution, according to article 128, n\u00ba 3 of the Constitution, in the 2010 version.\u201d In this case, he stressed, the elections must take place within a period of 120 days.<\/p>\n

This type of government was adopted because it is understood that experience has shown that there is a need to discipline actions in the transition from one Executive to the other.<\/p>\n

Another situation, he said, is the fact that the Law to Amend the Organic Law of General Elections has established a rule that limits inaugurations during the electoral campaign period.<\/p>\n
