Africa-Press – Botswana. The Gaborone High Court, presided over by Judge Oteng Motlhala, hear a case in which the state has applied to seize assets belonging to former minister Kefentse Mzwinila. The case follows allegations that Mzwinila’s properties and bank accounts are linked to proceeds of corruption. Judge Motlhala previously ordered law enforcement agencies to halt the seizure of these assets, giving time to review the court documents and ensuring due process is observed.

The Directorate of Public Prosecutions filed papers in December 2025, detailing several properties and bank accounts allegedly acquired through illicit activities. The assets are currently managed by a court-appointed receiver while the civil forfeiture process is underway. The application seeks to formally transfer control of these assets to the state, pending the outcome of the legal proceedings.

The Office of the Receiver has been instructed not to evict tenants or terminate employees at Mzwinila’s Ruretse properties. This measure aims to protect the rights of third parties who have no involvement in the alleged corruption. It also ensures that ongoing operations at these properties remain stable while the court reviews the matter.

Legal experts note that the case highlights Botswana’s commitment to fighting corruption and recovering public funds. The hearing will focus on the evidence linking the assets to unlawful gains and whether the state can justify their forfeiture. Judge Motlhala’s ruling is expected to set a precedent for future civil forfeiture cases, reinforcing accountability and transparency in the management of public resources.
