Africa-Press – Cameroun. <\/strong><\/span>Investir au Cameroun) – Le 15 fe\u0301vrier 2024, le tribunal administratif du Littoral (TAL), a rejete\u0301 la reque\u0302te en opposition formule\u0301e par Immigration & Business Canada (IBC), apre\u0300s l\u2019annulation par ladite juridiction du bail emphyte\u0301otique de 50 ans (renouvelable), conce\u0301de\u0301 par l\u2019E\u0301tat du Cameroun a\u0300 cette socie\u0301te\u0301 porteuse du projet de construction de l\u2019ho\u0302tel Marriot, sur un terrain d\u2019un peu plus de 2,63 hectares au quartier Bali, dans le 1er arrondissement de la capitale e\u0301conomique du Cameroun.<\/p>\n

D\u2019apre\u0300s Me Richard Nseke Njoh, l\u2019un des conseils des exproprie\u0301s de Bali, cette reque\u0302te a e\u0301te\u0301 de\u0301clare\u0301e \u00ab irrecevable pour de\u0301faut de qualite\u0301 \u00bb par la juridiction administrative. A\u0300 en croire ce dernier, il s\u2019agit d\u2019une nouvelle victoire pour les victimes et d\u2019un nouveau revers pour l\u2019E\u0301tat du Cameroun et son partenaire IBC. De\u0301ja\u0300, le 25 mai 2023, le TAL, statuant en premier et dernier ressort, a annule\u0301 les quatre de\u0301cisions administratives prises pour allouer un terrain a\u0300 la construction de ce complexe ho\u0302telier. C\u2019e\u0301tait a\u0300 la suite d\u2019un recours introduit en avril 2021 par des exproprie\u0301s qui de\u0301nonc\u0327aient le de\u0301cret du Premier ministre du 9 janvier 2020, violant, selon eux, la loi du 4 juillet 1985 relative a\u0300 l\u2019expropriation pour cause d\u2019utilite\u0301 publique.<\/p>\n

Seulement, l\u2019E\u0301tat du Cameroun conteste cette de\u0301cision et a forme\u0301 un pourvoi en cassation a\u0300 la chambre administrative de la Cour supre\u0302me. Une de\u0301marche qui consiste a\u0300 \u00ab appre\u0301cier si le juge du tribunal administratif a bien appre\u0301cie\u0301 la loi au cours de sa de\u0301cision initiale \u00bb, explique Me Richard Nseke Njoh. Ce dernier pre\u0301cise cependant que \u00ab les de\u0301cisions de la juridiction administrative sont exe\u0301cutoires en l\u2019e\u0301tat \u00bb. Il ajoute ne\u0301anmoins que le directeur ge\u0301ne\u0301ral d\u2019IBC, Olivier Chi Nouako, peut e\u0301galement saisir la chambre administrative de la Cour supre\u0302me pour contester le verdict. Ce dernier ne s\u2019est pas prononce\u0301 sur cette possibilite\u0301. Toutes les tentatives de le joindre au te\u0301le\u0301phone sont reste\u0301es vaines.<\/p>\n

En saisissant la Cour supre\u0302me, l\u2019E\u0301tat du Cameroun espe\u0300re une de\u0301cision favorable qui pourra relancer le projet de construction de ce complexe ho\u0302telier estime\u0301 a\u0300 60 milliards de FCFA. Il faut rappeler qu\u2019il est en gestation depuis une dizaine d\u2019anne\u0301es et le contrat de bail a e\u0301te\u0301 paraphe\u0301 le 10 aou\u0302t 2020 entre le ministre des Domaines, du Cadastre et des Affaires foncie\u0300res, Henri Eyebe Ayissia, et Olivier Chi Nouako.<\/p>\n
