Africa-Press – Cape verde. <\/strong><\/span>The proposed law that approves the Code of Military Justice was postponed again this Wednesday after five articles were suspended for analysis, and this Thursday, the 21st, the session will resume to conclude the diploma.<\/p>\n

After reviewing more than 30 articles out of the 280 that make up the diploma, articles 242, 250, 254 and 272 were suspended for analysis and will be resumed on Thursday, 21st, for discussion and approval of the proposed law.<\/p>\n

Article 242, which had already been suspended in the session of March 7th, due to a change in the article, more precisely in point 3, which establishes the appointment of military judges, was suspended again.<\/p>\n

This is because, contrary to the previous diploma, this new law proposes \u201cthe appointment of military judges by the member of the Government responsible for the area of \u200b\u200bnational defense on the proposal of the Chief of Staff of the Armed Forces after hearing the Superior Council of Commands\u201d.<\/p>\n

Article 250 regarding the appointment of judges and auditors was suspended due to the relationship it has with article 242.<\/p>\n

Article 254 regarding the appointment of the prosecutor was also suspended for the same reason as article 250.”<\/p>\n

Article 272 on the powers of the Chief of Staff was suspended due to a lack of consensus between the opposition and the Government.<\/p>\n

According to PAICV deputy De\u0301mis Almeida Lobo, they had doubts about the consensuality of the competence of general superintendence in the administration of military justice.<\/p>\n

\u201cWe understand that he should not have this competence. This is a competence of the Superior Council of Judiciary\u201d, he pointed out.<\/p>\n

In this sense, the session was suspended and will resume on Thursday, 21st to complete the approval of the diploma.<\/p>\n
