Africa-Press – Cape verde. <\/strong><\/span>The Institute of Cultural Heritage (IPC) has already consulted those involved in the administrative offense process initiated within the scope of the works on the Bodona Building, located in the historic center of the Plateau. If the infraction is proven, the fine can reach 2 million escudos.<\/p>\n

In a statement sent to the press this Thursday, IPC explains that the procedure aims to investigate the degree of culpability, intent or negligence of those involved, in this case the Municipality of Praia, as the entity that licenses and approves the projects of the properties in the historic center of Praia. Plateau and the owner of the property, who in this case is the defendant.<\/p>\n

If the existence of an infringement is proven, says the same source, a fine may be imposed. If there is no matter supporting the application of the sanction, the case will be closed.<\/p>\n

\u201cThe fine imposed in this case varies between 1,000,000$00 and 2,000,000$00, depending on the degree of fault\u201d, he explains.<\/p>\n

Additional sanctions may also be applied, such as the seizure of the goods subject to the infraction, closure of the establishment whose operation is subject to a license from an administrative authority and the suspension of authorizations, licenses and permits.<\/p>\n

It should be remembered that the Cultural Heritage Institute sent, last June, an extrajudicial injunction to the owner of the Bodona building, determining the immediate suspension of the work carried out on the property.<\/p>\n

\u201cThe constructions that were being carried out on the property, with historical and patrimonial value, de-characterize the vertical building, substantially altering its traditional architecture, its original volumetry and altimetry\u201d, maintained the IPC.<\/p>\n

The Bodona building, located in the Historic Center of the Plateau, is classified as a national cultural heritage, protected by article 18 n\u00ba 1 of the Legal Regime for Cultural Heritage, which states that \u201cclassified properties or properties in the process of being classified cannot be demolished, as a whole, or in part, nor be the object of restoration works, without the prior opinion of Organs competent bodies of the Ministry of tutelage\u201d.<\/p>\n
