According to the CSMP’s annual report on the situation of justice, productivity increased by 15.8% compared to the 2020\/2021 judicial year, the national backlog decreased by 5.8% and the procedural reference values \u200b\u200bset were exceeded. , at the national level, by 59.2%.<\/p>\n

Another aspect highlighted in this report concerns the efficiency and effectiveness of the mediation, arbitration and conflict resolution structures that were created and integrated into the Cape Verdean legal system, aiming, essentially, at facilitating access to law and justice, but also reduce the inflow of cases in the courts.<\/p>\n

The same source considers, however, that, despite the potential that these mechanisms have in terms of speedy resolution of disputes, their use by individuals and companies in case of dispute has not been successful, with the exception of \u201cad hoc\u201d arbitrations that have particularly in the real estate sector.<\/p>\n

To solve these shortcomings that impede the normal functioning of prosecutors, the CSMP recommends the Government to maintain the investment effort made in the justice sector and with a special focus on the Public Ministry, \u201cin order to increase productivity and reduce backlog at the national level, thereby creating the capacity for the response in terms of prosecuting criminal prosecution to be undertaken within a reasonable period of time\u201d.<\/p>\n
