Son statut de pre\u0301sident de l\u2019Union africaine le prote\u0300ge.<\/b><\/p>\n<p>Une grande premie\u0300re dans l\u2019histoire du pays. Le candidat Azali Assoumani n\u2019est point oblige\u0301 de s\u2019e\u0301carter de ses fonctions de pre\u0301sident de l\u2019Union dans la pe\u0301riode suivant publication de la liste de\u0301finitive des candidats jusqu\u2019a\u0300 l\u2019investiture du pre\u0301sident e\u0301lu. C\u2019est une de\u0301cision e\u0301manant de la haute juridiction. Dans un arre\u0302t publie\u0301 hier, la Cour supre\u0302me juge \u00ab inapplicable \u00bb l\u2019article 13 de la loi organique relative a\u0300 l\u2019e\u0301lection du pre\u0301sident de l\u2019Union. Ledit article dispose que \u00ab les candidats prennent conge\u0301 de leur poste e\u0301lectif ou nominatif sous peine de disqualification. A cet effet, ils doivent de\u0301poser aupre\u0300s de la Cour supre\u0302me, une de\u0301claration attestant ce conge\u0301, dans les soixante-douze (72) heures qui suivent la publication de la liste de\u0301finitive des candidats \u00bb.<\/p>\n<p>Cette de\u0301cision exceptionnelle de la Cour est motive\u0301e par le fait que les textes de l\u2019Union africaine, notamment l\u2019Acte constitutif et le re\u0300glement inte\u0301rieur de la Confe\u0301rence, priment sur le droit interne. Azali Assoumani e\u0301tant le pre\u0301sident en exercice de l\u2019Union africaine, il est donc exempte\u0301 de conge\u0301. \u00ab S\u2019il prend conge\u0301 de ses fonctions, c\u0327a serait par e\u0301le\u0301gance re\u0301publicaine. Mais rien ne l\u2019y oblige. Les textes de l\u2019Union africaine le prote\u0300gent \u00bb, conce\u0300de un juriste pluto\u0302t proche de l\u2019opposition.<\/p>\n<p>E\u0301lu en 2019 pour un mandat de cinq ans renouvelable une fois, Azali Assoumani veut rempiler. Il croisera le fer avec son ancien ministre de l\u2019inte\u0301rieur Mohamed Daoudou, son ancien ministre des affaires e\u0301trange\u0300res Aboudou Soefo, l\u2019ancien gouverneur de Ngazidja Mouigni Baraka Said Soilihi, l\u2019ancien pre\u0301sident de l\u2019assemble\u0301e nationale Hamidou Bourhane, et le novice Salim Issa Abdillah, candidat soutenu par la coalition de l\u2019opposition. La campagne sera officiellement lance\u0301e le 17 de\u0301cembre pour prendre fin le 12 janvier a\u0300 minuit.
