Africa-Press<\/a> – C\u00f4te d’Ivoire<\/a>. <\/strong><\/span>La Cour p\u00e9nale internationale (CPI) d\u00e9cide, ce mercredi 31 mars, si elle confirme ou annule l’acquittement prononc\u00e9 en 2019 de l’ex-pr\u00e9sident ivoirien Laurent Gbagbo, premier ancien chef d’Etat qu’elle a jug\u00e9, lors d’un proc\u00e8s pour crimes contre l’humanit\u00e9 li\u00e9s aux violences post-\u00e9lectorales en 2010 et 2011.<\/b><\/p>\n

Pr\u00e8s de 10 ans apr\u00e8s l’ouverture du dossier, la chambre d’appel de la CPI pourrait clore l’affaire en confirmant l’acquittement ou au contraire ouvrir la voie \u00e0 un nouveau proc\u00e8s, souhait\u00e9 par l’accusation. La procureure g\u00e9n\u00e9rale sortante de la Cour, Fatou Bensouda, a interjet\u00e9 appel en septembre 2019, huit mois apr\u00e8s l’acquittement.<\/p>\n

Accus\u00e9s de quatre chefs de crimes contre l’humanit\u00e9 – meurtres, viols, pers\u00e9cutions et autres actes inhumains – Laurent Gbagbo, 75 ans, et un de ses proches, Charles Bl\u00e9 Goud\u00e9, ex-chef du mouvement des Jeunes patriotes ivoiriens surnomm\u00e9 \u00ab\u00a0le g\u00e9n\u00e9ral de la rue\u00a0\u00bb, ont \u00e9t\u00e9 acquitt\u00e9s en janvier 2019 et lib\u00e9r\u00e9s sous conditions un mois plus tard.<\/p>\n

Ils ont toujours clam\u00e9 leur innocence dans ces crimes commis en 2010 et 2011 au cours des violences post-\u00e9lectorales ayant fait 3.000 morts en C\u00f4te d’Ivoire, n\u00e9es du refus de M. Gbagbo de reconna\u00eetre fin 2010 la victoire \u00e0 la pr\u00e9sidentielle de son rival Alassane Ouattara.Retour sur ces dix ann\u00e9es de proc\u00e9dure judiciaire<\/p>\n

Chargement du lecteur… Depuis son acquittement, M. Gbagbo vit en Belgique. La CPI a refus\u00e9 une demande de libert\u00e9 sans condition, mais a autoris\u00e9 l’ex-pr\u00e9sident \u00e0 quitter la Belgique vers un pays acceptant de le recevoir.<\/p>\n

L’arr\u00eat de la CPI sera prononc\u00e9 \u00e0 15H00 (13H00 GMT) par le pr\u00e9sident de la chambre d’appel et ancien pr\u00e9sident de la Cour bas\u00e9e \u00e0 La Haye, Chile Eboe-Osuji.<\/p>\n

Il n’a pas encore \u00e9t\u00e9 confirm\u00e9 si Laurent Gbagbo et Charles Bl\u00e9 Goud\u00e9 seront pr\u00e9sents dans la salle d’audience ou s’ils y assisteront par vid\u00e9oconf\u00e9rence, en raison des restrictions relatives au Covid-19, a d\u00e9clar\u00e9 \u00e0 l’AFP un porte-parole de la CPI.<\/p>\n

Erreurs de droit<\/b><\/p>\n

En possession, selon son avocate, de deux passeports, un ordinaire et un diplomatique, remis par les autorit\u00e9s ivoiriennes, l’ex-pr\u00e9sident avait annonc\u00e9 en d\u00e9cembre son d\u00e9sir de rentrer en C\u00f4te d’Ivoire, mais ce retour se fait toujours attendre.<\/p>\n

L’arr\u00eat de la CPI devrait \u00eatre suivi de pr\u00e8s en C\u00f4te d’Ivoire, o\u00f9 l’ombre de Laurent Gbagbo plane toujours sur une nation meurtrie par les violences politiques depuis plus de 20 ans. De nouvelles violences li\u00e9es \u00e0 la derni\u00e8re pr\u00e9sidentielle d’octobre 2020, remport\u00e9e par Alassane Ouattara qui se repr\u00e9sentait pour un troisi\u00e8me mandat controvers\u00e9, ont fait pr\u00e8s de 100 morts.<\/p>\n

Pr\u00e9sident de 2000 \u00e0 2010, M. Gbagbo, toujours tr\u00e8s populaire chez ses partisans, avait \u00e9t\u00e9 arr\u00eat\u00e9 en 2011. Apr\u00e8s son acquittement surprise – les juges ayant notamment estim\u00e9 que les preuves \u00e0 charge \u00e9taient insuffisantes -, le bureau de la procureure de la CPI avait estim\u00e9 que les magistrats n’avaient pas rendu une d\u00e9cision motiv\u00e9e en bonne et due forme et avaient commis des erreurs de droit et de proc\u00e9dure.<\/p>\n

Fatou Bensouda, ainsi que ses services, se trouvent sous le feu des critiques: si la CPI, fond\u00e9e en 2002 pour juger les pires atrocit\u00e9s commises \u00e0 travers le monde, a notamment condamn\u00e9 des chefs de guerre congolais et un jihadiste malien, l’accusation a \u00e9chou\u00e9 dans ses dossiers les plus embl\u00e9matiques.<\/p>\n","protected":false},"excerpt":{"rendered":"
