Africa-Press. <\/strong> <\/span>The Court of Justice of the West African Economic and Monetary Union (UEMOA) ruled that the sanctions imposed on Mali between January and July 2022 were unlawful, in a decision described as a political and legal victory for the transitional authorities in Bamako.<\/p>\n

The sanctions\u2014decided by the Economic Community of West African States (ECOWAS) and implemented by UEMOA\u2014included border closures, asset freezes, and the suspension of trade and financial transactions, aimed at pressuring the transition leaders to adopt an electoral timetable. Bamako deemed the measures \u201cillegal\u201d and filed an appeal before the Union\u2019s court in February 2022.<\/p>\n

The court said that UEMOA\u2019s enforcement of political sanctions issued by ECOWAS had no legal basis in UEMOA\u2019s own texts, given the Union\u2019s economic and monetary\u2014rather than political\u2014nature.<\/p>\n

Former Malian justice minister Mamadou Ismai\u0308la Konate\u0301 said the ruling reflects a clear separation between the legal systems of the two organizations, noting that the monetary union \u201cis not a political body,\u201d a point the court affirmed.<\/p>\n

Legal experts say the ruling\u2019s significance goes beyond procedure: the court explicitly declared the sanctions unlawful even though they were lifted in July 2022. The transitional authorities are expected to leverage the decision to bolster their political standing, although no official response has been issued so far.<\/p>\n

However, Mali will not be able to seek compensation, because the court held that the invalidation of the sanctions takes effect only \u201cfrom the date of the ruling,\u201d not retroactively. This clarification closes the door to any financial claims.<\/p>\n

The decision comes at a time of major shifts in Mali\u2019s relations with regional bodies, especially after it withdrew from ECOWAS in January 2024 alongside Niger and Burkina Faso, while remaining within UEMOA, which provides monetary stability and an important space for economic exchange.<\/p>\n

The sanctions had been imposed to push Mali back toward constitutional order, but the army, which has ruled the country for more than five years, has not yet held the promised elections.<\/p>\n
