{"id":10047,"date":"2022-08-01T11:12:45","date_gmt":"2022-08-01T11:12:45","guid":{"rendered":"https:\/\/www.africa-press.net\/eswatini\/all-news\/immigration-act-quiet-businessman"},"modified":"2022-08-01T11:57:43","modified_gmt":"2022-08-01T11:57:43","slug":"immigration-act-quiet-businessman","status":"publish","type":"post","link":"https:\/\/www.africa-press.net\/eswatini\/all-news\/immigration-act-quiet-businessman","title":{"rendered":"IMMIGRATION ACT QUIET &#8211; BUSINESSMAN"},"content":{"rendered":"<p><span style=\"color: #ff6600\"><strong>Africa-Press &#8211; Eswatini. <\/strong><\/span><b>Bangladesh immigrant Hossain Delowar (33) says he is not guilty of contravening the Immigration Act of 1982 by being within the country unlawfully.<\/b><\/p>\n<p>Delowar of Parkview Heights was charged with contravening section 14(2) of the legislation in that upon or about June 22, at or near Sidwashini he was said to have wrongfully and unlawfully entered and remained in the Kingdom of Eswatini without a valid document.<\/p>\n<p>In his defence, Delowar argued that he entered Eswatini lawfully in 2016 and had remained within the country lawfully because there was no time limit that he ought to have exited or extended his stay.<\/p>\n<p>Delowar said there was a much glaring loophole in the Immigration Act in that it did not have a provision that there was a limited time to stay for an immigrant to apply for a permit to continue staying in the country.<\/p>\n<p>He stated that neighbouring countries, South Africa and Mozambique, had stipulated 30 days stay.<\/p>\n<p>In comparison, he said it was clearly stipulated in Section 11(1) of the South African Immigration Act of 2002 that immigrants were entitled to 30 days stay limit subject to renewal.<\/p>\n<p>\u201cSection 14(2) of the Immigration Act of Eswatini must be given effect to state how a foreigner entering the country will be regulated\u201d, Delowar said, adding that this would be by means of permits which stipulate the conditions for those eligible to be granted.<\/p>\n<p>However, the State is opposed to his assertions.<\/p>\n<p>Principal Crown Counsel Macebo Nxumalo said Delowar was facing a state of affairs in that there was a set of circumstances in his situation whereby he entered the country but there were no records that he exited.<\/p>\n<p>Nxumalo said while he was in the country since 2016, Delowar ought to have applied for either a work, study or resident permit for him to continue to be within the country lawfully.<\/p>\n<p>\u201cHe finds himself offending by being in a place where he is prohibited to be.<\/p>\n<p>Therefore, the state of affairs must be interpreted in that, firstly the failure of the accused to terminate the state of affairs within reasonable time or prior to his conduct resulting in the situation which he finds himself in. Secondly, we submit that the accused had reasonable time to terminate the state of affairs but failed to do so,\u201d Nxumalo said.<\/p>\n<p>The Crown paraded Chief Immigration Officer Makhosi Simelane, who testified how the accused was said to be within the country unlawfully.<\/p>\n<p>Simelane, in his testimony, said even if the accused was in custody it did not deprive his employer or relatives from applying for a permit on the accused\u2019s behalf. The Crown argued that Delowar was able to get a six-month work permit in 2019 but when he was arrested, he did not have updated documents that he was in the country lawfully.<\/p>\n<p>Nxumalo said Delowar was facing another charge of being employed when he was arrested.<\/p>\n<p>However, Delowar said as per the evidence of Simelane, he entered lawfully in the country and had his passport stamped.<\/p>\n<p>\u201cHis entrance was authorised. Once you are in, you are in because you have been allowed entry.
