Africa-Press – Eswatini. <\/strong><\/span>High Court Judge Mumcy Dlamini has been dragged into controversy in the saga of a family dispute over the disposing of an estate, in which she has been accused of refusing to recuse herself from presiding in the case.<\/b><\/p>\n

Over the past two months, the High Court case and an interim order that stays the execution court order in the distribution of the estate, have taken centre stage in which the children of Christian Gunka Masuku have fought publicly.<\/p>\n

The Masuku children have been embroiled in the dispute that has been dragging for over 20 years as one of the siblings has been intent on disposing of their late parents\u2019 estate, without the consent from her siblings. In the most recent appeal filled in the Supreme Court, the applicant Dauglas Tee Masuku applied for interdicting Judge Dlamini who is cited as the seventh respondent from hearing any matters involving the above parties pending the appeals.<\/p>\n

Further interdicting and restraining the judge from making cost orders and or issuing any further orders, pertaining the estate of the late Masuku pending the appeals. Also vacating orders issued by the High Court of Eswatini as per Judge Dlamini after the applicant had filed notice(s) of appeal under the Supreme Court of Eswatini cases 10 of 2022, 25 of 2022, 54 of 2022 and 57 of 2022.<\/p>\n

The applicant also moved for directing Judge Zonke Magagula to proceed to finality with hearing the urgent application filed by the applicant on July 13. Also directing Judge Dlamini to issue written judgment compromising reasons for all orders issued for the estate of the late Christian Gunka Masuku.<\/p>\n

The eldest sibling, who lives abroad, Busisiwe Masuku, says her family is at odds with how the matter has been handled in court and further questioned why Judge Mumcy has refused to recuse herself in the matter.<\/p>\n

Masuku has come out to say that she was concerned that legally aware people were manipulating the laws of the land to disinherit her.<\/p>\n

She said her younger sister, Lobusuku was insistent of disposing of properties including their home at Moneni without her and her brother\u2019s consent.<\/p>\n

She added they had no intention of disposing of their properties as one of their homes had their relatives\u2019 graves including that of their father.<\/p>\n

According to Busisiwe, one of the properties at Trelawney Park in Manzini was allegedly sold by their sister behind their back and they were served with an eviction notice much to their shock and surprise.<\/p>\n

“When my brother who lives in South Africa went to the property for maintenance purposes, he found the gate locked and was later informed by the new owner that they had purchased the property. This promoted us to take legal action and demand for the sale to be reversed,” she said. She said on a number of occasions, she had attempted to ask the judge to recuse herself from the case but to no avail.<\/p>\n

\u201cMy younger sister refuses to recognise any appeal we lodge and only considers rulings made by her (judge) which according to me is in total disregard of the law,” she said. Busisiwe said she was concerned that the very same people who were expected to adhere to the country’s laws were the ones who disregarded it. She said there were numerous appeals that had been filled in court in an attempt to block an eviction order issued by the judge.<\/p>\n

She insisted that if justice were to prevail, the judge should have excluded herself from the case instead of persisting with the issuance of court orders allegedly meant to forcefully evict them from their home.<\/p>\n

She said she decided to call for her (judge) recusal because this was the last straw. She said as a family they were in a crisis and at loggerheads about the matter. “We are not willing to sell and we only want this matter to be resolved once and for all so we can move on,” added Masuku.<\/p>\n

She further stated that she was informed that her sister declined to follow procedure and refused to go to the Master of the High Court.<\/p>\n

She claimed that she learnt that her sister declined to follow the procedure and said she did not need to go to the masters\u2019 office and only uneducated people went there.<\/p>\n

The ongoing dispute has resulted in a total of six appeals lodged by their legal representative Thandeka Hlabangana who is a managing partner at Hlabangana and Associates based in Manzini.<\/p>\n

The latest development in the ongoing court battle saw the legal representative lodging an application on August 23 in the Supreme Court in terms of Section 148 of the Constitution.<\/p>\n

The family is seeking the intervention of the Supreme Court following numerous failed attempts to get a satisfactory ruling from the High Court.<\/p>\n
