The tender was awarded to another entity, whose name is withheld for legal purposes. Three companies were challenging the decision of the procuring entity not to award the tender for packaging and delivery of stationery for all public primary schools.<\/p>\n<p><b>Included<\/b><\/p>\n<p>This included Progress Stationery (Pty) Ltd, Boabab Printers and Stationery (Pty) Ltd and Masterpiece Stationery (Pty) Ltd, who were the applicants in the matter and the Ministry of Education and Training as the respondent. The application was dismissed by the Independent Review Committee (IRC) chaired by Kwanele Magagula. The applicant argued that in the previous years, they were providing the plastic bags sealed with sellotape. The respondent complained that the packaging they used to deliver the stationery had no re-use value since their packaging consisted of a plastic bag held together by tape. They then resolved that this year, they will send samples along with their tender documents with an improvement from their previous years\u2019 product. The new packaging contained a ziplock function, which meant that the packaging could be used repeatedly.<\/p>\n<p><b>Despite<\/b><\/p>\n<p>The applicant lamented that despite sending the desired sample (strong plastic bag with a ziplock function) their tenders were denied. Subsequent to the denial of the tender, the applicants wrote to the respondent appealing as to why they were denied the tender because the new samples were stronger than what they had previously supplied to the respondent. \u201cWe hereby wish to launch our formal discontent of a decision of the tendering board to deny Progress Stationery ( Pty) Ltd the opportunity to render its services per the above mentioned tender no; 60 of 2022-2023 . In particular, we wish to be furnished with reasons for issues that were raised concerning the plastic bag where the samples were packed in. Furthermore, we feel that our plastic bags were far superior to the previous ones,\u201d reads the application.<\/p>\n<p>The respondent responded to the first applicant, with a letter dated September 19, 2022 wherein the respondent gave reasons as to why the applicants were denied the tender. \u201cWe wish to draw your attention to the packaging specifications which were clearly prescribed, listed and use of bold print listed in the Tender Document (Page 30) for emphasis to demonstrate the importance of the requirements,\u201d reads part of the respondent response. The respondent added that this requirement was necessitated by previous experiences of such stationery spilling out during further packaging with the printed exercise books.<\/p>\n<p>They said this creates difficulties for the ministry as the process of repackaging contributes to loss of time and failure to meet time lines and set deadlines prior to schools opening. The applicant further contended that the respondent complained that in previous years their packaging was not satisfactory as stationary would spill out and could not be re-used. Further, they complained that the packaging in terms of the requirements of the tender \u2018must be closed with a clear wrapping tape, sealed with sellotape\u2019.<\/p>\n<p><b>Response<\/b><\/p>\n<p>In response to the complaint as already alluded to above, they sent samples superior to their previous product which addresses the issue of re- use and prevent stationery from spilling out.<\/p>\n<p>So their decision to move from the tape wrapping packaging was because of previous complaints made by the respondent concerning the durability of the packaging. On the bases of the above submissions, the applicants feel the decision not to award them the tender was irrational.
