Africa-Press – Eswatini. <\/strong><\/span>The Chartered Governance Institute of Southern Africa (CGISA) welcomes the decision by the ERS to consider the application of the In Duplum Rule on outstanding tax.<\/b><\/p>\n

The application of the In Duplum Rule means that if you have a debt of E100 then the interest charges cannot be more than E100, regardless of time. Interest cannot exceed the principle debt. This follows a newspaper publication of December 2021, where the CGISA through its President, Sandile Mbhamali, had expressed an appeal to the Eswatini Revenue Services (ERS) to consider applying the In Duplum Rule on their tax system, to avoid a situation where the tax obligation runs hay wire and spiral through the roof leaving the taxpayers unable to meets their overheads due to the huge tax burden. In his reaction to the latest developments, Mbhamali said the ERS had earlier argued that the In Duplum Rule only applied to consumers of products and loans, in terms of the consumer credit act which seeks to protect the consumers and did not apply to tax matters.<\/p>\n

He said, however, or position as the CGISA had remained the same in that impact of the departure to the In Duplum Rule by the ERS had dire consequences on the consumers, which required some considerations, since it also impacted on investor\u2019s confidence in the country, on both local and foreign direct investors. The president said as business consultants in the Accountants and Governance Professionals, they were always faced with the questions on local tax legislations and risks that were related to the tax laws from investors who wanted to enter the trading space of the country\u2019s economy. He said the absence of the In Duplum Rule was always a sore thumb when assessing the potential risks that were associated with the tax systems for potential investors and prospective businessmen.<\/p>\n

He said the fact that the tax systems shared similarities with of that neighbouring jurisdictions, did not justify or remove the reality of having a negative impact on the country\u2019s economy, by applying laws which were unfriendly to the individuals and companies in the country. Mbhamali said the In Duplum Rule was a common law rule which originated in Roman law and provided that interest on a loan or debt would cease to run when the amount of outstanding interest reaches the equivalent of the amount of the outstanding capital. He highlighted that government through the Ministry of Economic Planning and Development announces the inflation rates and dictates what the rates should state at a particular point in time, in order to stimulate the economy and influence the money in circulation.<\/p>\n

On the other hand the monetary policy by the Central Bank deals with issues of interest rates with an aim of regulating the money in circulation through the bank deposits and loans in issue. Thus tasked with announcing what the interest rates should be at a given particular point in time. Mbhamali added that the tax relief by ERS was expected to result in E1.7 billion tax written off from the accounts of taxpayers who originally had their principal taxes spiralling above the capital amount. This was per the announcement made by ERS last month.<\/p>\n
