Africa-Press – Eswatini. <\/strong><\/span>DHL Express Eswatini, a currier company that was represented by Derrick Jele of Robison Bertram law-firm has lost a case at the Industrial Court and as result, a car belonging to the company has been attached by Sheriffs.<\/b><\/p>\n

The Sheriffs grabbed the car on Tuesday as per the instructions from MLK Ndlangamandla Attorneys through a writ of execution dated 16th April 2024.<\/p>\n

This comes after the Currier company allegedly implemented wrong legal advice from their lawyers and suspended Khanyisile Oosthuizen without pay.<\/p>\n

The company, through advice from their lawyers, subsequently demonstrated arrogance and defended the matter at rhe Industrial Court, spending more than fifty thousand Rands(R50,000.00) on Robison Bertram lawyers while refusing to pay the employee a mere Fifteen Thousand Six Hundred and Ninety One Emalangeni, Seventeen cents(E15 691.17) and settle the matter.<\/p>\n

The judgement was delivered by Industrial Court Judge Lungile Msimango.<\/p>\n

On another note, some companies through advice from lawyers,have adopted a tendency of violating labour laws by unfairly dismissing or suspending employees without pay with the hope that, the employee will not have money to fight the endless court battles.<\/p>\n

Judge Msimango refused to refer to a questionable previous court judgement that justified the suspension of employees without pay.<\/p>\n

\u201cThe Respondent is directed to pay the Applicant’s salary for March 2024 and all subsequent months\u201d, reads the judgement in part.<\/p>\n
