Africa-Press – Eswatini. <\/strong><\/span>The Minister of Commerce, Industry and Trade Manqoba Khumalo says a lot of work is still to be done by the African continent to fully harness the largely untapped potential of the continent\u2019s creative and innovative industries.<\/b><\/p>\n

Khumalo was speaking during the inaugural Heads of Intellectual Property Offices Conference for African Regional Intellectual Property Organizsation (ARIPO) Member States held in the country last week.<\/p>\n

Historically, Africa has under-utilized the economic potential held in these creations of the mind. However, through gatherings such as this, the ARIPO member states are seeking to share ideas of maximising the returns to be made through efficient administration and commercialisation of intangible assets.<\/p>\n

Developing nations are encouraged to fully and actively participate in forums involving the use of Intellectual Property (IP) for economic growth. \u201cIt is generally agreed that economic development and growth that relies on IP as a catalyst can no longer be the purview of the advanced economies of the world,\u201d Khumalo said.<\/p>\n

Powerful<\/b><\/p>\n

According to the minister, IP is a powerful economic and socio-economic tool that holds a huge potential for making impact in our economies. However, it is a highly technical tool that requires constant simplification for uptake by the relevant stakeholders.<\/p>\n

\u201cThis Conference, is a platform for our distinguished delegates, to work together to explore and find ways to bring simplicity and solutions in the challenges that face us on our path to twenty first century industrialisation where IP protection plays a crucial role,\u201d he added.<\/p>\n

Eswatini has made a milestone on IP regulatory reforms towards unlocking the potential held by EmaSwati in using intangible resources for economic growth. \u201cWe have recently extensively reformed our IP statutory regime, consequently, this not only calls for a refocused outlook on IP, it also calls for new processes and procedures in the ways we carry out the administration of IP,\u201d he explained.<\/p>\n

Government continues to refine and update the IP administration with appropriate skills and capacity demanded by the new framework.<\/p>\n

The new IP Office leadership has renewed focus; a focus that moves away from mere registration of IP rights into a focus prioritising the commercial exploitation of those IP rights.<\/p>\n

As such the country expects to see tangible results in the economy of Eswatini.<\/p>\n

The complete change on the IP dispensation cannot be achieved while Eswatini works in isolation therefore in this regard, Government is seeking assistance from its partners such as the World Intellectual Property Organisation (WIPO), ARIPO and others with ways to achieve IP protection that works in tandem with IP commercialisation.<\/p>\n

On the same vein, Government is encouraging creators and innovators in the region to exploit the large IP that is available in the public domain in Eswatini\u2019s jurisdictions.<\/p>\n

The creative sectors that rely on copyright protection to thrive such as film, music, advertising, arts, fashion, entertainment and others were hard hit by the effects of the COVID-19 pandemic.<\/p>\n

In response to the pandemic\u2019s effects, Government has operationalised the new Copyright and Neighbouring Rights Act. The new Act provides for the creation of the Copyright Society, a body in which Government has injected funds to kick-start operations and activities that will see the equitable remuneration of creators of copyright content in the land.<\/p>\n

\u201cWe also have provisions in the Copyright legislation for the voluntary registration of copyright, which is a useful mechanism for those who want to ensure that the existence and priority of their copyright is properly recorded.<\/p>\n

This registration is useful for a myriad of commercial exploitation options that are available to the copyright creators,\u201d Khumalo added.<\/p>\n

The minister further challenged the conference to find ways whereby the administration of IP is of commercial benefit to developing nations, the creators within their jurisdiction and the global trading system as a whole.<\/p>\n

Chairperson of ARIPO Administrative Council Willie Mushayi says they are striving to make ARIPO more relevant and to evolve from purely registering IPR and assume a greater role in the 4th Industrial revolution to defend their vision; \u201cTo be Africa\u2019s leading intellectual property Organisation that promotes socio-economic development\u201d.<\/p>\n

Although ARIPO is threatened by the emergence of other IP organisations in the continent including the African Continental Free Trade Area (AfCFTA) negotiations, but ARIPO has to defend its own existence.<\/p>\n

\u201cIt should become the priority of all Registrars here to take up the challenge of transforming national IP offices into proper agents for economic development, as we seek to make IP even more relevant in our countries,\u201d Mushayi added.<\/p>\n

In developing the national IP Policies, it is important to involve all strategic stakeholders and make sure that it anchors well with the national development policies while embracing benchmarking from other organizations with similar mandates to ensure the IP policies are aligned to the broader global IP scope.<\/p>\n
