Africa-Press – Eswatini. <\/strong> <\/span>Amnesty International has warned of the consequences of continued deportations of migrants from the United States to a third country, expressing concern over what it described as serious human rights violations that may accompany these operations.<\/p>\n

This statement was made by the international human rights organization on Friday, following reports that 11 individuals were deported from the United States to Eswatini on July 8, marking what appears to be the fourth known transfer under the deportation agreement between the two countries.<\/p>\n

Flavia Mwangovya, the regional deputy director for Amnesty International for East and Southern Africa, stated that the organization has documented, over nearly a year, the serious consequences of these operations on human rights.<\/p>\n

Mwangovya explained that the violations documented by the organization included arbitrary detention, restrictions on the deportees’ access to lawyers, denial of due legal guarantees, and exposure to the risk of forced return to other countries.<\/p>\n

She emphasized that international law requires states to provide every person with the opportunity to appeal their transfer decision before it is executed, and prohibits the transfer of individuals to countries where they may face serious human rights violations or the risk of forced return.<\/p>\n

She added that states cannot evade their legal obligations regarding human rights through deportation arrangements to third countries, considering that the current transfers are part of the anti-migrant policies pursued by the administration of former President Donald Trump.<\/p>\n

She stated that these measures lead to family separations and cause psychological harm to affected individuals and communities.<\/p>\n

The organization noted that among those transferred to Eswatini were individuals who reportedly had received protection in the United States under the Convention Against Torture.<\/p>\n

It added that this aligns, according to the organization, with a pattern previously documented in cases of deportation to other African countries, where transfers included individuals who had previously been granted legal protection in the United States, including protection from torture.<\/p>\n

The organization affirmed that the protection provided by the Convention Against Torture cannot be circumvented through deportation arrangements to a third country.<\/p>\n

It also considered that the United States should not choose other countries to carry out mass deportations of individuals who had previously received protection within its territory.<\/p>\n

The organization called on the authorities in Eswatini to stop what it described as facilitating illegal transfers, demanding the immediate disclosure of the identities of the individuals who arrived in the country and their locations, and informing their lawyers and families, as appropriate, in addition to enabling independent monitors to follow up on them.<\/p>\n

It also demanded the disclosure of the legal basis for any action related to their deprivation of liberty, and ensuring that they urgently and confidentially receive access to legal services, interpreters, medical care, and consular assistance.<\/p>\n

Amnesty International called on the United States to end its policy of deportation to third countries and to halt what it described as a system of mass detention and deportation.<\/p>\n

It also urged the return of all individuals who were unlawfully transferred to their homes, families, and communities within the United States, and the release of all those arbitrarily detained under the existing arrangement between the United States and Eswatini.<\/p>\n

The organization emphasized the need to provide effective remedies for these individuals, including access to fair and effective asylum procedures in accordance with international standards.<\/p>\n

Amnesty International clarified that the recent arrival of 11 additional individuals to Eswatini, if officially confirmed as a new batch of deportees, would make it the fourth known transfer under this arrangement, raising the total number of individuals transferred to Eswatini to 30.<\/p>\n

It added that Eswatini is not the only African country that has received deportees from the United States, noting that it had previously expressed concern that at least 13 African countries have received or agreed to receive third-country nationals deported by the United States under similar arrangements.<\/p>\n
