Saisie le mardi le 3 janvier 2023 par REAGIR, elle a statue\u0301 ce jeudi 5 janvier 2023. Sa de\u0301cision est sans appel. Elle a prononce\u0301 la dissolution de l\u2019actuel bureau du CGE dirige\u0301 par Moi\u0308se Bibalou Koumba.<\/p>\n<p>Les 9 juges de la Cour ont donne\u0301 raison au parti REAGIR qui a saisi la Cour pour lui faire constater la violation de sa propre de\u0301cision par le gouvernement qui n\u2019a pas proce\u0301de\u0301 au renouvellement du bureau du CGE dans les de\u0301lais pre\u0301ce\u0301demment indique\u0301s par la haute juridiction.<\/p>\n<p>\u00ab Il est constate\u0301 la fin des pouvoirs du Bureau actuel du Centre Gabonais des Elections, suite au non renouvellement de celui-ci dans les de\u0301lais impartis par la Cour Constitutionnelle \u00bb, dispose l\u2019article 1er de la de\u0301cision de la Cour.<\/p>\n<p>C\u2019est une victoire pour le Le parti politique de\u0301nomme\u0301 Re\u0301appropriation du Gabon, de son Inde\u0301pendance pour sa Reconstruction (REAGIR), selon les termes d\u2019un communique\u0301 publie\u0301 a\u0300 chaud.<\/p>\n<p>En effet, ce parti repre\u0301sente\u0301 par son Vice-pre\u0301sident et son Secre\u0301taire Exe\u0301cutif, Etienne Francky Meba Ondo et Jean-Valentin Leyama, a saisi la Cour Constitutionnelle pour faire constater la violation par le Gouvernement de la de\u0301cision de la Cour Constitutionnelle n049\/CC du 06 octobre 2022 et, d\u2019autre part, de prononcer la dissolution pure et simple de l\u2019actuel Bureau du Centre Gabonais des Elections.<\/p>\n<p>La Cour a charge\u0301 \u00ab le Pre\u0301sident et les deux Vice-Pre\u0301sidents, assiste\u0301s du Secre\u0301taire Ge\u0301ne\u0301ral du Centre Gabonais des Elections, assurent l\u2019expe\u0301dition des affaires courantes jusqu\u2019a\u0300 la mise en place du nouveau Bureau \u00bb, selon l\u2019article 2 de la de\u0301cision.<\/p>\n<p>Marie Madeleine Mborantsuo et les 8 autres membres de la Cour ont fixe\u0301 un nouveau de\u0301lai pour organiser le renouvellement du bureau du CGE.<\/p>\n<p>\u00ab Le renouvellement du Bureau du Centre Gabonais des Elections doit intervenir dans les trente jours qui suivent la notification de la pre\u0301sente de\u0301cision \u00bb, pre\u0301cise l\u2019article 3 du texte.<\/p>\n<p>En septembre dernier, l\u2019opposition s\u2019e\u0301tait leve\u0301e contre la prorogation injuste du mandat de l\u2019actuel bureau du CGE e\u0301lu en 2018 pour un mandat de 2 ans renouvelable une fois. A cause de la pande\u0301mie du Covid 19 la Cour constitutionnelle avait constate\u0301 l\u2019impossibilite\u0301 de proce\u0301der au renouvellement du bureau du CGE. C\u2019est lorsque ce bureau a e\u0301puise\u0301 un second mandat de 2 ans que les partis politiques ont de\u0301cide\u0301 de contester sa le\u0301gitimite\u0301.<\/p>\n<p>Pour trancher ce de\u0301bat, la Cour a prit la de\u0301cision n049\/CC du 06 octobre 2022 qui ordonnait le renouvellement du bureau du CGE au plus tard le 15 de\u0301cembre 2022.
