Africa-Press – Gabon. <\/strong><\/span>Dans une de\u0301claration faite ce jeudi 31 aou\u0302t, le porte-parole du Comite\u0301 pour la transition et la restauration des institutions (CTRI), le Colonel Ulrich Manfoumbi, a, indique\u0301 que le nouvel homme fort de Libreville, le ge\u0301ne\u0301ral Brice Oligui Nguema pre\u0302tera serment lundi 04 septembre prochain, au palais du bord de mer, devant la cour constitutionnelle.<\/p>\n

Dans une de\u0301claration faite ce jeudi 31 aou\u0302t, le porte-parole du Comite\u0301 pour la transition et la restauration des institutions (CTRI), le Colonel Ulrich Manfoumbi, a, indique\u0301 que le nouvel homme fort de Libreville, le ge\u0301ne\u0301ral Brice Oligui Nguema pre\u0302tera serment lundi 04 septembre prochain, au palais du bord de mer, devant la cour constitutionnelle.<\/p>\n

Une cour constitutionnelle pourtant dissoute, le 30 aou\u0302t dernier -date du coup de force qui a cou\u0302te\u0301 la pre\u0301sidence a\u0300 Ali Bongo Ondimba- au me\u0302me titre que toutes les autres institutions qui tirent leur le\u0301galite\u0301 de la constitution, logiquement emporte\u0301e, elle aussi, par le re\u0301gime de\u0301chu.<\/p>\n

Quoique le porte-parole du CTRI ait pris le soin de pre\u0301ciser dans sa de\u0301claration que la Cour constitutionnelle sera temporairement re\u0301tablie pour la cause, n\u2019empe\u0302che que cette de\u0301marche suscite interrogations et controverses dans l\u2019opinion.<\/p>\n

D\u2019aucuns n\u2019he\u0301sitent pas d\u2019y voir un me\u0301lange de genres, pour la bonne et simple raison que le coup d\u2019e\u0301tat est un re\u0301gime d\u2019exception, non pre\u0301vu par la constitution pour laquelle les membres de la Cour constitutionnelle sont des gardiens infaillibles.<\/p>\n

Le ge\u0301ne\u0301ral de brigade Brice Clotaire Oligui Nguema, qui n\u2019est pas un Pre\u0301sident e\u0301lu, devrait tout au plus se contenter d\u2019une ce\u0301re\u0301monie d\u2019installation officielle, en pre\u0301sence de ses fre\u0300res d\u2019armes, sans avoir besoin de la bienveillance d\u2019une Cour constitutionnelle \u00ab dissoute \u00bb et \u00ab re\u0301habilite\u0301e \u00bb dans un jeu de tiroirs que les professionnels du droit gagneraient a\u0300 expliciter.<\/p>\n

Remettre l\u2019ancienne cour et ses membres dans le jeu, reviendrait pour la junte a\u0300 conduire la transition sur la base du dispositif le\u0301gal et institutionnel contre lequel elle s\u2019est attaque\u0301e le 30 aou\u0302t e\u0301coule\u0301.<\/p>\n

Et c\u2019est le serpent qui se mord la queue, s\u2019est confie\u0301 l\u2019air abattu, un militant de la socie\u0301te\u0301 civile gabonaise.<\/p>\n
