Africa-Press – Gambia. The Banjul High Court presided over by Justice Ebrima Jaiteh has ordered Uncle Sam Security Services Company Limited and Alieu SBM Jallow to pay D7,923,523.35 as arrears of Social security contributions owed to its employees from March 2005 to December 2008.
The judge also ordered Uncle Sam to pay the D287,942.97 as arrears for injury compensation contributions for the same period with interest accruing at the rate of 21.5% per annum from 1st January, 2009 until the date of judgement.
The judge further ordered Mr Jallow and his company to pay D100,000 in costs.
The judgement was delivered in a civil suit between Social Security and the defendants for the latter’s failure to fulfill its social contributions for its employees.
Alieu SBM Jallow, as proprietor, holds a 65% majority share in Uncle Sam Security company with his seven children sharing the remaining 35% shares.
Justice Jaiteh said during Uncle Sam Security’s contractual engagement with the Social Security, it repeatedly failed to fulfill its financial obligations in not only defaulting on paying contributions but also underreporting employee salaries.
The judge asserted that investigations exposed that while 40% of salaries were designated for contributions “a startling” 60% went undeclared “buried under allowances” which is a flagrant violation of trust that has dire repercussions on the livelihoods of the employees.
The judge pointed out that there is compelling evidence before the court that Uncle Sam did not only fail in its legal duties but also breached ethical responsibilities regarding the management of employee contributions and savings.
