Africa-Press – Gambia. The trial of Ousainou Bojang, accused in the alleged police shooting incident, took a significant turn today at the High Court as the defense moved to summon top government officials to testify.

Counsel Lamin J. Darboe, representing the first accused, Ousainou Bojang, filed an application seeking to subpoena three prominent state officials: Ebrima G. Sankareh, Government Spokesperson; Babucarr Jeng, National Security Adviser; and Momodou Sowe, Deputy Inspector General of Police.

Darboe requested that the officials be compelled to appear before Justice Jaiteh to provide testimony regarding public comments they allegedly made concerning the case.

The application was strongly opposed by the Director of Public Prosecutions (DPP), who argued that Counsel Darboe had neither identified the specific venues where the alleged statements were made nor provided any supporting evidence to substantiate the claims.

Counsel A. Sillah, representing the second accused, Amie Bojang, supported Darboe’s motion and emphasized that the court is empowered to issue two types of subpoenas: subpoena ad testificandum, which compels an individual to appear and testify, and subpoena duces tecum, which requires the production of documents.

Sillah further argued that the court holds inherent authority to compel any capable witness to testify or submit relevant documents.

Following the submissions, Justice Jaiteh adjourned proceedings briefly to deliberate on the application. The court’s ruling on whether the subpoenas will be granted is now eagerly awaited.
