Court Orders NHRC Lawyer to Amend Brief in FGM Case

Africa-Press – Gambia. The Supreme Court of The Gambia presided over by Honorable Justice Edrisa Mbai on Monday ordered the National Human Rights Commission [NHRC]’s lead lawyer Emmanuel Denial Joof to amend and file his brief of argument in the Pro-Female Genital Mutilation lawsuit filed against the State.

Appearing before a single-Judge of the Supreme Court, the lead lawyer Emmanuel Daniel Joof told the court that he had filed a brief of argument on 4 July 2025, seeking to be joined as parties [defendant] in the FGM lawsuit.

However, the presiding Judge put it to lawyer Joof that the brief in question was not before the court, ordering the NHRC lawyer Joof to amend and file the same before the court. Joof is expected to amend and file his brief of argument before the court before next sitting.

Meanwhile , court records shows that the Pro=FGM lawsuit was filed by Foni legislator, Hon. Almamy Gibba alongside Yassin Fatty, Nano Jawla, Kadijatou Jallow, Concerned Citizens, Islamic Enlightenment Society, Women’s Association for Islamic Society Solidarity and Gambia Women Are Free to Choose Association against the State.

The Pro-FGM complainants [plaintiffs] are seeking an order from the court a declaration to strike out sections 32A and 32B of the Women’s Amendment Act NO. 11 of 2015 from the Women’s Act of 2010 so that only section 32 the original provision of the Women’s Act 2010 will be maintained.
