The <\/strong><\/span>Constitutional Review Commission (CRC) today<\/span><\/span>announced that it is on track to<\/span><\/span>deliver a\u00a0<\/span><\/span>d<\/span><\/span>raft Constitution<\/span><\/span>. \u201c<\/span><\/span>Consistent with its terms of reference, t<\/span><\/span>he CRC is well poised<\/span><\/span>\u00a0<\/span>to deliver\u00a0<\/span><\/span><\/strong>to Gambians at\u00a0home<\/span>\u00a0and\u00a0abroad<\/span>\u00a0a draft<\/strong> Constitution\u00a0<\/span><\/span>that will engender public debate and comments before finalisation<\/span><\/span>\u201d<\/span><\/span>,<\/span><\/span>\u00a0said the Chairperson of the\u00a0<\/span><\/span>CRC<\/span><\/span>, Justice Cherno\u00a0<\/span><\/span>Sulayman\u00a0<\/span><\/span>Jallow, QC.<\/span><\/span><\/h1>\n<\/header>\n<\/div>\n

He intimated that significant\u00a0<\/span><\/span>strides have\u00a0<\/span><\/span>been made\u00a0<\/span><\/span>in collating and analyzing the public opinions received during<\/span><\/span>the CRC\u2019s<\/span><\/span>\u00a0consultation processes<\/span><\/span>.<\/span><\/span>\u00a0The public opinions were gathered through different processes to ensure that a broad spectrum of Gambian<\/span><\/span>s were reached in order to ensure a fair balance to guide the CRC in making informed decisions during the drafting process. The<\/span><\/span>se<\/span><\/span>\u00a0processes were the face-to-face dialogue with Gambians at\u00a0home, face-to-face dialogue with Gambians living\u00a0abroad, focused\u00a0group<\/span>\u00a0discussions, dialogue with select Senior Secondary Schools, conduct of household surveys using specified enumeration\u00a0areas<\/span>,\u00a0administration<\/span>\u00a0of online survey questionnaires, dialogue with stakeholders (both public and private), the CRC Issues Document and responses thereto, independent submissions to the CRC, and contributions made through social and the print media.\u00a0<\/span><\/span>Justice Jallow indicated that the public consultation process<\/span><\/span>\u00a0has been a very challenging but fruitful one<\/span><\/span>and he and his colleague Commissioners have learnt a lot<\/span><\/span>\u00a0in terms of the views and aspirations of Gambians and other stakeholders.<\/span><\/span><\/p>\n

The CRC also wishes to assure the public that\u00a0<\/span><\/span>a\u00a0<\/span><\/span>lot of work has been\u00a0<\/span><\/span>going on<\/span><\/span>\u00a0behind the scene to ensure that\u00a0<\/span><\/span>The Gambia\u00a0<\/span><\/span>is counted among countries that have\u00a0<\/span><\/span>progressive<\/span><\/span>Constitution<\/span><\/span>s<\/span><\/span>. Therefore, the CRC\u00a0<\/span><\/span>wishes to assure the public that\u00a0<\/span><\/span>it is doing its best to keep to its mandate and to deliver a draft Constitution for public consultation within the next few weeks.<\/span><\/span><\/p>\n

It is\u00a0<\/span><\/span>the\u00a0<\/span><\/span>CRC<\/span><\/span>\u2019s expectation<\/span><\/span>\u00a0to\u00a0<\/span><\/span>publish\u00a0<\/span><\/span>the draft Constitution<\/span><\/span>online\u00a0<\/span><\/span>and to make\u00a0available<\/span>\u00a0a limited number of hard copies,\u00a0<\/span><\/span>and to\u00a0<\/span><\/span>thereafter\u00a0<\/span><\/span>embark on another\u00a0<\/span><\/span>round<\/span><\/span>\u00a0of\u00a0<\/span><\/span>face-to-face\u00a0<\/span><\/span>consultations with Gambian<\/span><\/span>s across the country to ensure that there is a good review process<\/span><\/span>\u00a0through active participation<\/span><\/span>.<\/span><\/span>\u00a0The d<\/span><\/span>ate\u00a0<\/span><\/span>and\u00a0<\/span><\/span>v<\/span><\/span>enues\u00a0<\/span><\/span>for the next round of consultations will be duly communicated to the public.\u00a0<\/span><\/span>The period for public consultations will be one month from the date of publication of the draft Constitution; the face-to-face dialogue within the country is envisaged to be for a two-week period. This will enable the CRC to\u00a0complete<\/span>\u00a0its assignment as mandated under the Constitutional Review Commission Act, 2017.<\/span><\/span><\/p>\n

The CRC is\u00a0<\/span><\/span>cognizant of\u00a0<\/span><\/span>the high\u00a0<\/span><\/span>expectations\u00a0<\/span><\/span>of<\/span><\/span>Gambians\u00a0<\/span><\/span>concerning the\u00a0<\/span><\/span>drafting\u00a0<\/span><\/span>of this new<\/span><\/span>\u00a0national document<\/span><\/span>\u00a0of monumental importance<\/span><\/span>.\u00a0<\/span><\/span>While the draft Constitution is not expected to touch upon or\u00a0address<\/span>every public opinion that has been canvassed, the CRC hopes that by publishing the draft Constitution the general public will have a good opportunity to review the draft and make constructive contributions in its finalisation. \u00a0<\/span><\/span>Therefore, the\u00a0<\/span><\/span>CRC<\/span><\/span>\u00a0remain<\/span><\/span>s<\/span><\/span>\u00a0committed\u00a0<\/span><\/span>to its mandate<\/span><\/span>and will<\/span><\/span>\u00a0continue<\/span><\/span>\u00a0to ensure that the\u00a0<\/span><\/span>constitutional review<\/span><\/span>process continue<\/span><\/span>s<\/span><\/span>\u00a0to be<\/span><\/span>\u00a0guided by the principles of T<\/span><\/span>ransparen<\/span><\/span>cy<\/span><\/span>,\u00a0<\/span><\/span>P<\/span><\/span>articipat<\/span><\/span>ion<\/span><\/span>Inclusivene<\/span><\/span>ss, Representation,<\/span><\/span>and National Ownership<\/span><\/span>.<\/span><\/span><\/p>\n

The five technical committees established to\u00a0<\/span><\/span>assist<\/span><\/span>\u00a0the<\/span><\/span>CRC<\/span><\/span>\u00a0with expert inputs have all submitted their reports to the Commission. International consult<\/span><\/span>ants<\/span><\/span><\/span>\u00a0with good track records in the review and drafting of Constitutions in Africa,\u00a0<\/span><\/span>were also<\/span><\/span>\u00a0received recently by the CRC as part of its strategy to consult widely and harness best practices within and outside of The Gambia, in order to deliver a document that\u00a0<\/span><\/span>reflects international best practices consistent with the values and aspirations of Gambians<\/span><\/span>. The\u00a0<\/span><\/span>Consultants will continue their\u00a0assignments<\/span>\u00a0until such time as is necessary leading to the preparation of the final draft Constitution<\/span><\/span>.<\/span><\/span><\/p>\n

Work continues\u00a0<\/span><\/span>in earnest\u00a0<\/span><\/span>at the\u00a0<\/span><\/span>CRC\u00a0<\/span><\/span>S<\/span><\/span>ecretariat to\u00a0assist<\/span>the Commission in achieving its ultimate\u00a0<\/span><\/span>objective of<\/span><\/span>drafting\u00a0<\/span><\/span>a sound Constitution which reflects the collective values, beliefs and aspirations of all Gambians, and a report<\/span><\/span>\u00a0in relation to the process of drafting the Constitution.<\/span><\/span><\/p>\n

The CRC\u00a0<\/span><\/span>wish<\/span><\/span>es\u00a0<\/span><\/span>to use this opportunity to\u00a0<\/span><\/span>thank<\/span><\/span>\u00a0and<\/span><\/span>congratulate fellow Gambians\u00a0<\/span><\/span>and other stakeholders\u00a0<\/span><\/span>for their enthusiasm, support and\u00a0<\/span><\/span>positive\u00a0<\/span><\/span>contributions, and also to encourage them to continue to support the Commission as it\u00a0<\/span><\/span>journeys to the conclusion of its<\/span><\/span>assignment<\/span><\/span>.\u00a0<\/span><\/span>The Commission\u00a0<\/span><\/span>remains committed\u00a0<\/span><\/span>to its mandate\u00a0<\/span><\/span>and\u00a0<\/span><\/span>is therefore\u00a0<\/span><\/span>determined to deliver a draft Constitution that will reflect, as far as possible, the\u00a0<\/span><\/span>wishes and aspirations<\/span><\/span>\u00a0of the\u00a0<\/span><\/span>Gambian\u00a0<\/span><\/span>people<\/span><\/span>, which take into account and embody, to the extent considered feasible, international\u00a0<\/span><\/span>best practices<\/span><\/span>.<\/span><\/span><\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"
