Africa-Press – Gambia. <\/strong><\/span>Lawyers of the embattled FTX Founder, Sam Bankman-Fried are accusing the prosecutors in the lawsuit against their client of \u201csandbagging\u201d the process to put their client in the \u201cworst possible light\u201d.<\/b><\/p>\n

The lawyers were responding to a Friday night request by federal prosecutors that Bankman-Fried not be allowed to talk with most employees at FTX or his Alameda Research hedge fund without lawyers present, or use the encrypted messaging apps Signal or Slack and potentially delete messages automatically.<\/p>\n

Bankman-Fried, 30, has been free on US$250-million bond since pleading not guilty to charges of fraud in the looting of billions of dollars from the now-bankrupt FTX.<\/p>\n

Prosecutors said their request was in response to Bankman-Fried\u2019s recent effort to contact a potential witness against him, the general counsel of an FTX affiliate, and was needed to prevent witness tampering and other obstruction of justice.<\/p>\n

But in a letter to US district judge Lewis Kaplan in Manhattan, Bankman-Fried\u2019s lawyers said prosecutors sprung the \u201coverbroad\u201d bail conditions without revealing that both sides had been discussing bail over the last week.<\/p>\n

\u201cRather than wait for any response from the defence, the government sandbagged the process, filing this letter at 6pm on Friday evening,\u201d Bankman-Fried\u2019s lawyers wrote. \u201cThe government apparently believes that a one-sided presentation \u2014 spun to put our client in the worst possible light \u2014 is the best way to get the outcome it seeks.\u201d<\/p>\n

Bankman-Fried\u2019s lawyers also said their client\u2019s efforts to contact the general counsel and John Ray, installed as FTX\u2019s chief executive during the bankruptcy, were attempts to offer \u201cassistance\u201d and not to interfere.<\/p>\n

A spokesman for US attorney Damian Williams in Manhattan declined to comment.<\/p>\n

Bankman-Fried\u2019s lawyers proposed that their client have access to some colleagues, including his therapist, but not be allowed to talk to Caroline Ellison and Zixiao \u201cGary\u201d Wang, who have pleaded guilty and are cooperating with prosecutors.<\/p>\n

They said a Signal ban isn\u2019t necessary because Bankman-Fried is not using the auto-delete feature, and concern he might is \u201cunfounded\u201d.<\/p>\n

The lawyers also asked to remove a bail condition preventing Bankman-Fried from accessing FTX, Alameda or cryptocurrency assets, saying there was \u201cno evidence\u201d he was responsible for earlier alleged unauthorised transactions.<\/p>\n

In an order on Saturday, Kaplan gave prosecutors until Monday to address Bankman-Fried\u2019s concerns.<\/p>\n

\u201cThe court expects all counsel to abstain from pejorative characterizations of the actions and motives of their adversaries,\u201d the judge added.<\/p>\n
