Africa-Press – Gambia. <\/strong><\/span>Former presidential affairs minister Momodou Sabally has acknowledged the receipt of $2000 from Dr. Abubakary Jawara but Sabally said this was in return of a favour he did for the GACH boss.<\/b><\/p>\n

Sabally and Dr. Jawara met in court for the first time on Friday in a day-long gruelling proceedings around Dr. Jawara\u2019s defamation suit against the former secretary general and head of the civil service.<\/p>\n

The trial began sometime last year.<\/p>\n

Led in cross-examination by defense attorney Ida Drammeh, Sabally told the Banjul High Court annex that without his intercession, former Gambian President Yahya Jammeh would\u2019ve grabbed GACH\u2019s property.<\/p>\n

\u201cI did something for him because the President (Yahya Jammeh) wanted to seize his property and I prevailed on him,\u201d Mr. Sabally stated when it was put to him that the GACH CEO once gave him $2000 when he approached him for support to publish his book.<\/p>\n

\u201cSo, you thought he should be obliged to help you,\u201d counsel Drammeh asked.<\/p>\n

\u201cI didn\u2019t do that for money,\u201d replied Sabally.<\/p>\n

ILL-INTENTION<\/b><\/p>\n

Leading Mr. Sabally through cross-examination, counsel Drammeh asserted that the \u201cfalse\u201d publications that Sabally made against her client were borne out of malice.<\/p>\n

Referring Mr. Sabally to one of his articles about the GACH CEO in which, he said, Dr. Jawara should be charged with economic crimes for prospecting black sand in Sanyang.<\/p>\n

\u201cIn exhibit PF10, you said the plaintiff should be charged with economic crimes as the former government used to,\u201d counsel Drammeh tried to refresh Mr. Sabally\u2019s memory.<\/p>\n

\u201cWhen you said he should be charged in exhibit PF10, you said he committed a crime for black sand mining,\u201d she then quizzed.<\/p>\n

\u201cI was speaking from social advocate point of view,\u201d replied the former head of the civil service.<\/p>\n

\u201cYou even advised the lawyers as to what crime he should be charged with,\u201d the counsel said.<\/p>\n

When Sabally responded affirmatively to her query that he termed himself as champion of youths, counsel Drammeh said: \u201cI want to put it to you that the statements you put were made with malicious intent.\u201d<\/p>\n

\u201cNo. They were made in public interest,\u201d replied Mr. Sabally.<\/p>\n

New Love Affair With Yellow<\/b><\/p>\n

Earlier on in the cross-examination, counsel Drammeh asked Mr. Sabally as to whether it was correct that he never wore yellow outfits during his time in the Jammeh government.<\/p>\n

\u201cIs it correct that you joined the UDP recently, \u201casked counsel Drammeh.<\/p>\n

\u201cI joined the UDP two years ago,\u201d responded Sabally.<\/p>\n

\u201cAnd before you joined the UDP, you were with APRC,\u201d counsel Drammeh further asked.<\/p>\n

\u201cI served as Secretary General on appointment,\u201d Mr. Sabally agreed.<\/p>\n

\u201cAnd APRC was the party of former President Jammeh,\u201d stated counsel Drammeh.<\/p>\n

\u201cYes,\u201d answered Sabally.<\/p>\n

\u201cIs it correct that you never wrote any critical article against Jammeh,\u201d the counsel enquired.<\/p>\n

\u201cI was a columnist and I did criticize government policies,\u201d Sabally disagreed.<\/p>\n

Meanwhile, Sabally said he knew about some of Dr. Jawara\u2019s businesses when asked by the counsel whether he knew her client\u2019s business details before the defamation case.<\/p>\n

On his publications, Sabally acknowledged under cross-examination that he had a very wide social media following by the Gambian standard.<\/p>\n

\u201cWhen you are writing, you are writing to get media attention from your followers,\u201d asked counsel Drammeh.<\/p>\n

\u201cI say the truth and defend the public interest, regardless of who,\u201d replied Sabally.<\/p>\n

\u201cYour these principles only came into existence only when you stopped serving Yahya Jammeh,\u201d counsel Drammeh asserted.<\/p>\n

\u201cThat\u2019s not correct,\u201d Sabally disagreed.<\/p>\n

Asked whether he was aware that several mining licences have been issued in the previous regime, Mr. Sabally said he knew of only Gamico.<\/p>\n

Meanwhile, Sabally said he could not remember the appointment of Dr. Jawara as consul during the Jammeh dispensation.<\/p>\n

Sabally meantime said under cross-examination that he wasn\u2019t too sure that he\u2019s an intelligent man.<\/p>\n

\u201cBut you said you are a prominent politician,\u201d stated counsel Drammeh.<\/p>\n

\u201cWhat made you prominent,\u201d attorney Drammeh asked.<\/p>\n

\u201cI am always on the frontline, sensitizing people about their civic duties,\u201d Sabally replied.<\/p>\n

\u201cYou said things with the belief that what you said will be acted upon\u201d counsel Drammeh enquired.<\/p>\n

\u201cIt\u2019s for political consciousness,\u201d explained Sabally.<\/p>\n

\u201cIs it correct that a responsible person will verify facts before publication,\u201d counsel Drammeh demanded.<\/p>\n

\u201cIt depends on the operational aspect,\u201d Sabally argued.<\/p>\n

\u201cYou did not take responsibility to check that any statement you made is not false,\u201dcounsel Drammeh countered.<\/p>\n

\u201cThat\u2019s not right,\u201d retorted Sabally.<\/p>\n

\u201cSo, you see yourself as not having responsibility,\u201d argued counsel Drammeh.<\/p>\n

\u201cOut of principles and conviction, I made sure whatever I published were verified,\u201d Sabally contended.<\/p>\n

When asked who determines his \u201cstatus\u201d as \u201cthe most high-profile\u201d social media and political commentator, Sabally said the public was the judge.<\/p>\n

\u201cYour public,\u201d lawyer Drammeh stated.<\/p>\n

\u201cYes,\u201d concurred Sabally.<\/p>\n

Sabally meanwhile said he received a letter from Dr. Jawara\u2019s lawyer through the social media before it was physically delivered to him and that he consequently replied to it, saying he would never send an apology to Dr. Jawara as demanded in that letter sent by lawyer Mene.<\/p>\n

He also admitted saying that he would never apologize for billion years for publishing articles deemed by Dr. Jawara as defamatory.<\/p>\n

\u201cAnd you dared let him go to court,\u201d asked counsel Drammeh.<\/p>\n

\u201cI said let him go to court,\u201d said Sabally.<\/p>\n

\u201cIs it true that you said you are not, in a billion years, apologizing,\u201d counsel Drammeh quizzed Sabally.<\/p>\n

BANTA KEITA<\/b><\/p>\n

The former presidential adviser responded in the negative when quizzed whether he knew Banta Keita.<\/p>\n

Asked whether it\u2019s correct that his post, linking the GACH CEO to drugs could go viral.<\/p>\n

\u201cIt depends on the content. If the content is appealing, it can go viral,\u201d Sabally replied.<\/p>\n
