Africa-Press – Gambia. <\/strong><\/span>Millionaire entrepreneur Dr. Abubakary Jawara on Friday informed the Banjul High Court that black sand mining licences have been issued to people since 1926, describing his relations with the community of Sanyang as cordial.<\/b><\/p>\n

Dr. Jawara sometime last year initiated a legal action against former presidential affairs minister Momodou Sabally for allegedly painting his mining activities in the coastal community of Sanyang as exploitative and destructive.<\/p>\n

The GACH CEO was at Banjul High Court annex on Friday where he was subjected to hours of intense cross-examination by Sabally\u2019s attorney.<\/p>\n

\u201cGACH mining was issued a licence to mine black sand and, is that true,\u201d quizzed defense counsel Abdoulie Fatty.<\/p>\n

\u201cYes, the licence was issued to me for black sand mining and it has been issued to people since 1926,\u201d Dr. Jawara stated.<\/p>\n

Still testifying under cross-examination, the GACH boss said he followed due process when he sought mining licence.<\/p>\n

\u201cWhen you were making an application for sand mining licence, did you submit a project brief, environmental plan,\u201d enquired counsel Fatty.<\/p>\n

\u201cI only followed due process and I fulfilled all the requirements,\u201d responded the plaintiff.<\/p>\n

\u201cI will put it to you that according to one Lamin Camara, due process was not followed,\u201d counsel Fatty fired back.<\/p>\n

\u201cObjection, my lord,\u201d Dr. Jawara\u2019s counsel I. Drammeh rose to say.<\/p>\n

\u201cWith all due respect, I don\u2019t think that\u2019s fair. If he connects anything to Lamin, let Lamin be invited,\u201d senior counsel Drammeh argued.<\/p>\n

\u201cMy learned friend is trying to restrict me,\u201d contended counsel Fatty.<\/p>\n

However, Justice Bakre presiding, concurred with senior counsel Drammeh.<\/p>\n

\u201cAnd, I agree with her because the questions you asked were not pleaded,\u201d Justice Bakre pointed out.<\/p>\n

\u201cI will withdraw the questions,\u201d recanted Fatty.<\/p>\n

Meanwhile, when asked by Sabally\u2019s lawyer whether he fulfilled his tax obligation, the GACH CEO replied: \u201cI paid my taxes. As we started the mining operations, Corona came and we had some issues. But if you want to know whether I pay tax or not, you can contact Gambia Revenue Authority (GRA).\u201d<\/p>\n

Counsel Fatty then put it to CEO Jawara that mining operations have already begun before Corona hit.<\/p>\n

\u201cI got the licence in 2017 but I didn\u2019t start that year. If you want to know more, you can contact the Department of Geology. I couldn\u2019t remember the period of time between registration and commencement of mining operations,\u201d Dr. Jawara explained.<\/p>\n

He said he had no black sand mine in Kitty when asked by counsel Fatty whether he was also mining in Kitty village in Kombo Central.<\/p>\n

When further asked whether he\u2019d ever encountered any problem with the community of Sanyang, Dr. Jawara replied: \u201cI never had any problem with the people of Sanyang. It\u2019s only peace that exists between us.\u201d<\/p>\n

\u201cDid you spend D2.8m to rehabilitate Sanyang police station,\u201d counsel Fatty enquired.<\/p>\n

\u201cThat was our corporate, social responsibility,\u201d GACH boss answered before adding: \u201cWe\u2019ve reached a community impact agreement. They approached me for the rehabilitation of the station and I did it for them.\u201d<\/p>\n

Dr. Jawara disagreed with counsel Fatty\u2019s assertion that the station was burnt down in protest against GACH\u2019s mining operations in Sanyang.<\/p>\n

\u201cI\u2019m putting it to you that you offered this money to pacify the youths based on your operations,\u201d counsel Fatty stated.<\/p>\n

\u201cThat\u2019s incorrect. Factories were burnt in the protest but my black sand mining site was spared,\u201d the GACH boss said.<\/p>\n

Dr. Jawara testified while being cross-examined that he never had any problem with the women vegetable growers in Sanyang.<\/p>\n

\u201cI am putting it to you that the locals, particularly the women, who grew vegetables in Sanyang, said their crops were suffering because of your activities,\u201d Sabally\u2019s lawyer stated.<\/p>\n

\u201cI never had any problem with anybody in Sanyang,\u201d Dr. Jawara explained. He then added: \u201cAny time I want to expand my mining activities into anybody\u2019s land, I negotiate and pay compensation. The VDC and Alkalo are my witnesses.\u201d<\/p>\n

And, when Sabally\u2019s attorney insisted on his position that black sand mining activities were causing food insecurity and environmental degradation and that the situation was so bad in the Jammeh era that mining activities had to be frozen, Dr. Jawara responded: \u201cThat\u2019s not correct. Since 1926, these sand mining operations had been taking place in the area. The one, who defamed my character, was part of those who lifted the ban.\u201d<\/p>\n

\u201cIn fact, you are right. It (black sand mining) resumed under Jammeh,\u201d counsel Fatty agreed. He added: \u201cBut he (Jammeh) chose his cronies like Muhammed Bazzi.\u201d<\/p>\n

The case resumes next Friday.<\/p>\n
