Africa-Press – Gambia. <\/strong><\/span>Lawyer Ousainou Darboe, the leader of the United Democratic Party (UDP) and the lead-counsel for his party in the case against Fatoumata Jahumpa Ceesay (FJC) and Ousman Rambo Jatta, has addressed the Supreme Court that their \u201cappointments in the foreign services do not exist in law\u201d.<\/b><\/p>\n

Their appointment was \u201cunconstitutional\u201d as it violated sections 169 and 170 of the Constitution of The Gambia, the UDP leader argued.<\/p>\n

\u201cThe Constitution is clear on the President\u2019s power to make appointments,\u201d lawyer Darboe said, adding that every citizen has the right to challenge any conduct that contravenes the Constitution, citing Section 5 of the Constitution.<\/p>\n

In this case, his party challenges the President\u2019s appointment of two people in the foreign services. Darboe argued that constitutional guarantees are guarding against politicising such positions.<\/p>\n

He said the appointments of FJC and Rambo were \u201cdone in bad faith and should be nullified\u201d by the Supreme Court. He referred to the evidence they tendered, which include mainly videos and their transcripts.<\/p>\n

Darboe discussed one of the videos where Fatoumatta Jahumpa Ceesay was introduced as the party leader, quoting the transcript: \u201cOur party leader is coming, a woman of substance who makes the party proud. Let me welcome my lord, Her Excellency, the Ambassador of South Africa Honourable Fatoumatta Jahampa Ceesay.\u201d<\/p>\n

The other video Darboe discussed was related to the APRC Congress in which Fatoumatta Jahampa was presenting the congress report as the Secretary General of the party.<\/p>\n

\u201cSo, My Lords, there is nothing in their defence that protects them from section 170 of the Constitution,\u201d Darboe stated.<\/p>\n

In view of the claims against Rambo Jatta, lawyer Darboe said that in a video obtained from Kerr Fatou, which was already tendered and admitted in evidence, Rambo was saying, \u201cI am Rambo Jatta, the Second Party Leader of the APRC and a seasoned politician…\u201d<\/p>\n

Darboe said the announcement of the resignation of Rambo and FJC was only made after the case was filed against them. He added that their resignations were announced by Musa Amul Nyassi and also published in the Standard Newspaper The Gambia.<\/p>\n

\u201cThe announcement did not come until this case was filed. There was no resignation before the case, but once the case was filed they resigned,\u201d Darboe argued.<\/p>\n

The senior lawyer submitted that their appointment was \u201cunconstitutional\u201d and had \u201cno legal basis\u201d. He argued that the President acted \u201ccontrary to the provisions of the Constitution\u201d when he appointed them.<\/p>\n

Placing heavy reliance on cases from Nigeria, lawyer Darboe said the two appointments were a nullity for one day.<\/p>\n

\u201cIf a decision or proceeding is smeared with nullity, it is void and taken as if it was never given or made,\u201d Darboe said.<\/p>\n

Darboe said the Supreme Court has to set aside or nullify their appointments since their appointments do not exist in law.<\/p>\n

\u201cSince the decision is offensive to the law, it must be mowed down by the unbiased judicial sword of this court,\u201d Darboe said.<\/p>\n

He referred the court to sections 166 and 170 of the Constitution, saying: \u201cAny appointment that did not follow the Constitution, the court has to declare that it as a nullity as this Supreme Court did in the case of Yakumba Jaiteh versus the clerk of the National Assembly.\u201d<\/p>\n

Darboe said all appointees in the foreign services should come from the Ministry of Foreign Service and not from political parties.<\/p>\n

\u201c Their resignation cannot validate their appointments and the court has to declare the appointments null and unconstitutional,\u201d Darboe concluded.<\/p>\n

Counsel Ida Drammeh, representing Fatoumata Jahumpa Ceesay (FJC) and Ousman Rambo Jatta, informed the Supreme Court that she only needed ten minutes to make her oral arguments in the case filed by the UDP and Madi M.K. Ceesay, the National Assembly Member for Serrekunda West.<\/p>\n

UDP and its member, Madi Ceesay, filed the case against FJC, Rambo, the Public Service Commission and the Attorney seeking a court order to stop FJC and Rambo from serving in the public service as Ambassador and Counsellor respectively.<\/p>\n

Lawyer Darboe then requested from the court that the written brief of Lawyer Drammeh should be served to them. It was granted by the court.<\/p>\n

The case comes up tomorrow at 09:30 am. After the argument of Lawyer Drammeh, the Court will fix a date for judgment.<\/p>\n
