{"id":864,"date":"2019-09-21T14:36:23","date_gmt":"2019-09-21T14:36:23","guid":{"rendered":"https:\/\/www.africa-press.com\/gambia\/?p=864"},"modified":"2019-09-21T14:36:23","modified_gmt":"2019-09-21T14:36:23","slug":"janneh-commission-white-paper-publication","status":"publish","type":"post","link":"https:\/\/www.africa-press.net\/gambia\/community\/janneh-commission-white-paper-publication","title":{"rendered":"Janneh Commission White Paper Publication"},"content":{"rendered":"<p><strong>You will recall that\u00a0upon the installation of the Barrow administration\u00a0in 2017, preliminary reports received from,\u00a0inter alia, the Central Bank of The Gambia, Social Security and Housing Finance Corporation (SSHFC), Gambia Ports Authority (GPA), Gambia Telecommunications Company Limited (GAMTEL), National Water and Electricity Company Limited (NAWEC), Assets Management and Recovery Corporation (AMRC), Gambia National Petroleum Corporation (GNPC), and other public institutions and government agencies, indicated that substantial funds were, either directly or indirectly withdrawn, paid out or expended on instructions or directives received from the Office of the President during the tenure in office of former President Jammeh, sometimes for unknown purposes.<\/strong><\/p>\n<p>It was discovered that bank accounts were opened into which funds paid by members of the public and intended for the State were directly controlled and expended by former President Jammeh or on his instructions.<\/p>\n<p>It was also discovered that former President Jammeh, during his tenure in office, had accumulated at least 131 known landed properties registered in his name or in companies and foundations in which he has shares or an interest; and that he operated at least 89 private bank accounts directly or through the aforesaid companies or foundations.<\/p>\n<p>Based on these preliminary reports, President Barrow deemed it in the public interest to launch an inquiry into the financial and other activities of public bodies, enterprises, and offices as regards their dealings with former President Jammeh, his family members and close associates, his financial and business affairs, and the assets accumulated by them during his tenure in office.<\/p>\n<p>Accordingly, in exercise of the powers conferred on him by Section 200 of the Constitution of the Republic of The Gambia 1997, and the Commissions of Inquiry Act Cap 30:01 Vol 5 of the Laws of The Gambia, His Excellency, Adama Barrow, President of the Republic of The Gambia, on 12th\u00a0July, 2017, issued a\u00a0Commission of Inquiry into the financial and other related activities of certain public bodies, enterprises and offices as regards their dealings with former President Jammeh, and the accumulation of assets by him, his family members and close associates,\u00a0and for connected\u00a0matters\u00a0through Gazette\u00a0Legal Notice 15 of 2017, ISSN 0796\u00a0with the following membership:-<\/p>\n<p>i.\u00a0SURAHATA B.S. JANNEH \u2013 Chairperson<\/p>\n<p>ii.\u00a0ABIOSSEH GEORGE \u2013 Member<\/p>\n<p>iii.\u00a0BAI MASS SAINE \u2013 Member<\/p>\n<p>1.\u00a0The Commission was assisted by Counsel Amie N.D. Bensouda who was appointed by me.<\/p>\n<p>2.\u00a0The members of the Commission were\u00a0thereafter\u00a0sworn-in and the terms of reference of the Commission\u00a0included to:-<\/p>\n<p>a)\u00a0Inquire into and investigate the circumstances surrounding the withdrawal of diverse sums of money from the Central Bank of The Gambia including from the International Gateway Account, Carnegie Mining Project Account, and any other account or fund lodged with the Central Bank and:<\/p>\n<p>b)\u00a0Inquire into and investigate the involvement of the Executive arm of Government under former President Jammeh in the withdrawal and application of funds or resources of public bodies, enterprises and offices \u00a0or projects including but not limited to SSHFC,\u00a0GPA, GAMTEL, NAWEC, AMRC, GNPC.<\/p>\n<p>c)\u00a0Inquire into whether and to what extent the resources meant for the Government or people of The Gambia including grants, donations, and loans were diverted, converted or misappropriated by or under the direction of the former Executive;<\/p>\n<p>d)\u00a0Investigate the extent to which former President Jammeh was involved in public procurement and whether any losses were caused to government by reason of such involvement;<\/p>\n<p>e)\u00a0Investigate the existence, nature, extent, and method of acquisition of assets and properties of former President Jammeh, his family members and close associates within the period from 22ndJuly 1994 to 21st\u00a0January 2017, and to investigate whether such assets and properties were acquired lawfully or otherwise;<\/p>\n<p>f)\u00a0Investigate the companies, businesses, and bank accounts operated directly or indirectly by former President Jammeh and his close associates or in which he had an interest<\/p>\n<p>g)\u00a0Identify whether any person or group of persons committed any offence in relation to any matter inquired into by the Commission;<\/p>\n<p>h)\u00a0Recommend ways of improving on the supervision of Government Accounts in a bid to ensuring that irregular withdrawals from the said accounts do not reoccur;\u00a0and<\/p>\n<p>i)\u00a0Recommend ways of recovering or restoring any assets, monies or other resources that may have been illegally taken, misappropriated, misapplied or lost.<\/p>\n<p>The Commission submitted its Report in Nine (9) volumes totaling One Thousand and Six Hundred pages (1,600) to the President on 29 March 2019.<\/p>\n<p>Following a review of the Commission\u2019s Report,\u00a0and in accordance with Section 203 of the Constitution,\u00a0His Excellency, President Barrow, has decided to publish his reaction to the Report in\u00a0the form of a\u00a0White Paper to be published here today together with the full Report of the Commission. Because of its voluminous size, we can only share a few complimentary copies of the Report with the media today and encourage the\u00a0general\u00a0public to obtain copies from the GPPC in Kanifing.<\/p>\n<p>First,\u00a0the\u00a0Government wishes to highlight the commendable work of the Commission in general, and the procedure adopted by the Commission in its investigations and public hearings. The transparent manner in which it conducted its proceedings and the extra-ordinary measures it had adopted in order to ensure fairness and adherence to law and due process is highly commendable.<\/p>\n<p>The Commission has made a number of findings and recommendations in its Report.\u00a0The Government has carefully considered the Report and in its\u00a0White Paper has stated its decisions and accepts (except as otherwise stated in the\u00a0White Paper) the findings and recommendations as they relate to the issues brought out in the Report.<\/p>\n<p>In taking\u00a0the decisions reflected in its\u00a0White Paper, the Government has not lost sight of the prevailing governance environment created by former President Jammeh at the time. Notwithstanding, in most cases, members of the business community, in their dealings with former President\u00a0Jammeh, were motivated by\u00a0greed and opportunism; while those who served in public office were mostly motivated by a combination of fear and self-preservation. The Government has also taken into account the fact that The Gambia is currently going through a fragile political transition to democratic rule after over two decades of dictatorship. Consequently, the Government\u2019s main objective,\u00a0as reflected in the\u00a0White Paper, is the recovery of monies stolen and\/or misappropriated from the State by former President Jammeh, his family members and close associates.<\/p>\n<p>For the avoidance of doubt, the\u00a0White Paper does not and neither is it intended to reflect all the findings and recommendations of the Commission. It only contains the key findings and recommendations that the Government wishes to highlight from the Report, and mirrors the\u00a0findings and recommendations against\u00a0the list of\u00a0individuals identified\u00a0in Volume 9 of the Report.<\/p>\n<p>Some of the key findings of the Commission include the fact that\u00a0former President Jammeh, who was the primary subject of the Commission\u2019s inquiry, and who\u2019s salary\u00a0in July 1994 when he took over power was D2,744.20:<\/p>\n<p>was engaged in an unconscionable land grab and\u00a0acquired\u00a0281 (two hundred and eighty-one)\u00a0landed properties throughout the country. These include private residential and commercial properties, islands, forest parks, wild life reserves and wetlands.<\/p>\n<p>The Commission\u00a0also\u00a0found that\u00a0disproportionate amounts of resources were wasted, misappropriated and diverted\u00a0by\u00a0former President Jammeh\u00a0amounting to at least\u00a0D1,065,012,512\u00a0(one billion and sixty-five million, and twelve thousand Dalasis);\u00a0\u00a0$304, 718, 071(three hundred and four million, and seven hundred and eighteen thousand and seventy-one Dollars).<\/p>\n<p>That the meager resources at the disposal of the country were managed\u00a0at former President Jammeh\u2019swhim and caprices without regard to the structures and processes in place to ensure coherence and accountability;\u00a0that\u00a0former President\u00a0Jammeh, from his actions, reserved the right to appropriate funds from wherever they were available to him, for procurement of goods and services and made no distinctions as to whether the project was for his personal benefit or for public purposes;<\/p>\n<p>that at least\u00a0D3,330,046.60\u00a0(three million, and three hundred and thirty thousand, and forty-six Dalasis);$1,858,367\u00a0(one million, and eight hundred and fifty-eight thousand, and three hundred and sixty-seven Dollars);\u00a0and\u00a0GBP6,618.41\u00a0(six thousand, and six hundred and eighteen Pounds Sterling), mostly in cash, was improperly authorized and directly transferred for use by Zineb Jammeh from various \u00a0accounts\u00a0in the country.<\/p>\n<p>The Commission found that former President Jammeh\u2019s financial dealings and\/or activities were at all stages<br \/>\nfacilitated, assisted or even guided by a number of people. The Commission has identified seventeen<\/p>\n<p>persons (17) as close associates of former President Jammeh based on the evidence before it. These include military officers who left with him into exile, private individuals and companies that had business dealings with him either directly or indirectly through companies in which former President Jammeh had an interest.<\/p>\n<p>Apart from persons who fall in the said category,\u00a0the Commission also found that there were\u00a0others who worked with former President Jammeh by virtue of the offices they held, many of whom were also involved in his financial dealings and\/or activities.<\/p>\n<p>The Commission underscored that the damage former President Jammeh has caused to Government institutions, public resources and State Owned Enterprises is of such serious nature that the Government ought to introduce a motion before the National Assembly for charges to be brought against\u00a0him\u00a0for theft, economic crimes and corruption.<\/p>\n<p>Based on the recommendations of the Commission, the actions taken by the Government is expected togenerate\u00a0nearly\u00a0a\u00a0Billion Dalasis\u00a0from the assets forfeited to the State and to be sold.<\/p>\n<p>However, it should also be emphasized that the Commission was not only established for the recovery of monies even though it was equally important that there was a credible and transparent process of accountability which provided us with the legal and evidentiary basis for our recovery efforts. The Commission was also meant to expose the level of corruption and the extent of reckless disregard for fiscal discipline and safeguards against abuses. Therefore, the Commission has made a number of policy recommendations in order to improve on\u00a0these\u00a0safeguards.<\/p>\n<p>Thank you
