Prosecutors told the court that Sarr used violence in an attempt to rob Halimatou Barry, a staff member of AMM Forex Bureau.<\/p>\n<p>During the proceedings, Police Prosecutor S. Manjang, a Cadet Inspector, applied for the matter to be transferred to the High Court of The Gambia, arguing that the Magistrates\u2019 Court lacks jurisdiction to try capital offences.<\/p>\n<p>\u201cYour Worship, the Magistrates\u2019 Court does not have the jurisdiction to try capital offences that carry penalties of life imprisonment or death,\u201d Inspector Manjang submitted.<\/p>\n<p>He relied on Section 72(1) of the Criminal Procedure Act 2025, requesting that the case be referred to the Special Criminal Division of the High Court for a full hearing and determination.<\/p>\n<p>Sarr is charged with attempted robbery with violence, contrary to Section 249(2)(a)(c) of the Criminal Offences Act 2025.
