Sambou delivered the ruling in a case filed by Batch Sonko against Alagie Ndure, in which the plaintiff sought repossession of land and the eviction of the defendant.<\/p>\n<p>Court documents showed that the matter was initiated through a praecipe dated 23 February 2026, seeking an order for possession of a plot measuring 30 metres by 43 metres in Old Yundum.<\/p>\n<p>The case first came before the court on 10 March 2026 but could not proceed due to the defendant\u2019s absence. An affidavit of service indicated that the defendant had refused to accept court processes. The court nonetheless adjourned the matter to 13 March 2026 to allow him another opportunity to appear.<\/p>\n<p>On the adjourned date, the defendant again failed to attend court. The court subsequently ordered substituted service, which was carried out to notify him of the proceedings.<\/p>\n<p>Despite being duly served, the defendant did not appear in court.<\/p>\n<p>The court therefore invoked Section 7 of the Subordinate Courts Civil Proceedings Act and entered judgment in default.<\/p>\n<p>Magistrate Sambou granted the plaintiff possession of the disputed land and ordered the immediate eviction of the defendant.
