{"id":116939,"date":"2026-04-11T07:33:48","date_gmt":"2026-04-11T07:33:48","guid":{"rendered":"https:\/\/www.africa-press.net\/ghana\/uncategorized\/evaluating-impact-of-jfap-on-ghanas-prisons-a-stopgap-or-solution"},"modified":"2026-04-11T08:02:23","modified_gmt":"2026-04-11T08:02:23","slug":"evaluating-impact-of-jfap-on-ghanas-prisons-a-stopgap-or-solution","status":"publish","type":"post","link":"https:\/\/www.africa-press.net\/ghana\/all-news\/evaluating-impact-of-jfap-on-ghanas-prisons-a-stopgap-or-solution","title":{"rendered":"Evaluating Impact of JFAP on Ghana\u2019S Prisons, a Stopgap or Solution?"},"content":{"rendered":"<p><span style=\"color: #ff6600\"><strong>Africa-Press &#8211; Ghana. <\/strong><\/span><b>The implementation of the Justice for All Programme (JFAP) is making a significant impact in Ghana\u2019s justice delivery system.<\/b><\/p>\n<p>The JFAP brings court proceedings directly into prison facilities and responds to systemic delays in the justice system as the nation\u2019s experiences overcrowding in her prisons, with thousands of remand prisoners living under difficult conditions.<\/p>\n<p>To bridge the gap between the courts and remand inmates, the PFAJ is expediting cases, raising critical questions about fairness, access, and the broader administration of justice.<\/p>\n<p><b>Background<\/b><\/p>\n<p>Introduced in 2007, the JFAP is a state-led initiative aimed at reducing the number of remand prisoners to address overcrowding and protection of rights and dignity of prisoners.<\/p>\n<p>The JFAP operates through a multi-institutional partnership, involving the Judicial Service, the Office of the Attorney-General, the Ghana Prisons Service, the Ghana Police Service, CHRAJ and the POS Foundation, an NGO.<\/p>\n<p>Specialised mobile courts sit within prison facilities to review cases, grant bails as well as accelerate trials where appropriate.<\/p>\n<p>The implementation of the JFAP started in Accra and has since been expanded nationwide.<\/p>\n<p>During the COVID-19 pandemic era, virtual hearings were introduced under the \u201cJustice for All Amid COVID-19 initiative,\u201d decentralising access to justice and strengthening legal aid support for the disadvantaged detainees.<\/p>\n<p><b>Purpose and Scope<\/b><\/p>\n<p>The JFAP seeks to deliver justice to inmates who have often waited years without trial.<\/p>\n<p>Speaking at a recent in-prison court session in Sunyani, Justice Angelina Mensah-Homiah, a Justice of the Court of Appeal, said the JFAP complemented, rather than replacing the conventional court processes.<\/p>\n<p>She said the programme played a critical role in reducing case backlogs, decongesting prisons, and upholding inmates\u2019 constitutional rights.<\/p>\n<p><b>Roots of Reform<\/b><\/p>\n<p>Hitherto, Justice Mensah-Homiah said the nation\u2019s prison system was under severe strain with inmate population standing around 13,800 and remand prisoners numbering 4,218 representing about 30.57 per cent.<\/p>\n<p>She said the overcrowding exceeded 72 per cent of capacity, as many detainees remained in custody for years, sometimes longer than the maximum sentence for their alleged offences.<\/p>\n<p><b>Gains and Lives changed<\/b><\/p>\n<p>Justice Mensah-Homiah the statistics from the Ghana Prison Service (GPS) revealed that the nation\u2019s prison population stood at 13,432 as of March 25, 2026, saying that 11,789 of the inmates\u2019 representing 87.77 percent were convicted while 1,643 of them representing 12.23 per cent were on remand.<\/p>\n<p>The figures she added were a sharp decline from the 30.57 per cent recorded in 2007 and attributed to the progress to improved collaboration within the criminal justice chain.<\/p>\n<p>\u201cJudges, prosecutors, law enforcement agencies, and legal aid providers are working in tandem to deliver timely justice,\u201d Justice Mensah-Homiah stated.<\/p>\n<p>She said the JFAP\u2019s impact was deeply human, offering inmates closure through release, bail or sentencing and replacing prolonged uncertainty with clarity.<\/p>\n<p><b>Congestion challenges<\/b><\/p>\n<p>Superintendent Dennis Peasah, said the Bono, Bono East and Ahafo Regional Public Relations Officer of the GIS, prison conditions remain challenging worrying severe overcrowding at the Sunyani Central Prison.<\/p>\n<p>He said the central prison was built in the 1960s to house 400 inmates, but now accommodated more than 600 inmates, nearly 80 to 90 percent above capacity.<\/p>\n<p>Supt. Peasah expressed concern about limited space, strained resources, and heightened health risks at the prisons.<\/p>\n<p>He suggested that increasing the number of in-prison court sittings annually could accelerate progress and enhance responsiveness within the justice system.<\/p>\n<p><b>Constitutional imperative<\/b><\/p>\n<p>Justice Mensah-Homiah said Article 14(4) of the 1992 Constitution, required that those detainees ought to be tried within a \u201creasonable time\u201d or be released however, there was no clear definition of a \u201creasonable time.\u201d<\/p>\n<p>She said the JFAP addressed the gap by fast-tracking cases that might otherwise remain indefinitely stalled or abandoned.<\/p>\n<p><b>Beyond decongestion<\/b><\/p>\n<p>Though the JFAP has significantly reduced congestion, there is the need to reinforce the rule of law.<\/p>\n<p>Justice Mensah-Homiah described the JFAP as a reflection of the nation\u2019s commitment to fairness and human rights, saying that timely hearings strengthened public confidence in the justice delivery system.<\/p>\n<p>She said the programme further protected vulnerable inmates, with emphasis on those without legal representation through support from the Public Defenders Division.<\/p>\n<p><b>Progress and challenges<\/b><\/p>\n<p>Justice Mensah-Homiah said in-prison sessions held between December 2025 and March 2026 at Nsawam, Kumasi, Tamale, Koforidua, and Ho had reduced the number of remand prisoners there.<\/p>\n<p>She said investigative delays, limited resources and procedural inefficiencies contributed to prolonged detention, saying that the JFAP itself was not frequent enough to address all pending cases.<\/p>\n<p><b>Reform and sustainability<\/b><\/p>\n<p>The future of the JFAP appears promising, particularly under the leadership of Chief Justice Paul Baffoe-Bonnie amid the planned judicial reforms.<\/p>\n<p>Those reforms include expanded use of plea bargaining under Section 162(A) of Act 1079, which are expected to further ease congestion and streamline criminal trials.<\/p>\n<p>There is also growing emphasis on improving investigative efficiency to prevent unnecessary pre-trial delays.<\/p>\n<p>Nonetheless, Justice Mensah-Homiah said: \u201cThe goal isn\u2019t to expand the programme indefinitely, saying that as the criminal justice system became more efficient, the need for the programme would be reduced.<\/p>\n<p><b>Strengthening the system<\/b><\/p>\n<p>Mr Eric Opoku Brobbey, the Bono, Bono East and Ahafo Regional Director of Legal Aid, called on stakeholders of the JFAP to perform their roles effectively, saying that beneficiaries of the programme were vulnerable individuals without the means to secure legal representation.<\/p>\n<p>\u201cA just society must endeavour to protect its most disadvantaged members,\u201d he stated, saying that a properly functioning justice system would eliminate the need for special interventions like the JFAP.<\/p>\n<p>He said that: \u201cThe issue is not merely about resources, but about institutional responsibility and timely action.\u201d<\/p>\n<p><b>Way forward<\/b><\/p>\n<p>Undoubtedly, sustaining the gains of the JFAP requires addressing delays at the source through strengthening investigations and coordination.<\/p>\n<p>There is also the need to expand and regularise JFAP sittings with digital support for efficiency and scale up legal aid alongside alternative sentencing to cut unnecessary remands and ease prison congestion.<\/p>\n<p>Ultimately, the long-term goal ought to be a justice system that functions efficiently enough to render interventions less necessary.<\/p>\n<p>However, until then, the JFA programme remains a vital, though interim, tool to safeguard against prolonged pre-trial detention.<\/p>\n<p><b>Source: Ghana News Agency<\/b><\/p>\n<p><strong>For More News And Analysis About <span style=\"color: #ff6600\">Ghana<\/span> Follow <span style=\"color: #ff6600\">Africa-Press<\/span><\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Africa-Press &#8211; Ghana.
