{"id":12807,"date":"2020-08-14T14:58:15","date_gmt":"2020-08-14T14:58:15","guid":{"rendered":"https:\/\/www.africa-press.com\/kenya\/?p=12807"},"modified":"2020-08-14T14:58:15","modified_gmt":"2020-08-14T14:58:15","slug":"apex-court-declines-to-strike-out-sh5-6-billion-tax-suit","status":"publish","type":"post","link":"https:\/\/www.africa-press.net\/kenya\/economy\/apex-court-declines-to-strike-out-sh5-6-billion-tax-suit","title":{"rendered":"Apex court declines to strike out Sh5.6 billion tax suit"},"content":{"rendered":"<p><strong>Author: Kamau Muthoni\u00a0<\/strong><br \/>\n<strong>AfricaPress-Kenya:<\/strong> The Supreme Court has dismissed an application to strike out a Sh5.6 billion tax suit filed by Kenya Revenue Authority (KRA) against international soft drinks manufacturer Coca Cola Company.<\/p>\n<p>Coca Cola had objected to apex court judges hearing the appeal, arguing there was no constitutional issue to be interpreted in the dispute.\u00a0However, a four-judge bench led by Chief Justice David Maraga and Justices Mohamed Ibrahim, Smokin Wanjala and Njoki Ndung\u2019u found that\u00a0the crust of the case was on the application of sections of Customs and Excise Act.<\/p>\n<p>\u201cIn view of the reasons tendered, we find that this court has jurisdiction in respect of this appeal. Having so found, we have no option but to dismiss the preliminary objection,\u201d the court ruled.<\/p>\n<p>The case stems from a Sh5.6 billion demand by KRA. The revenue authority argued that\u00a0the firm\u00a0failed to pay its excise duty between 2006 and 2008 on returnable crates and empty soda bottles.\u00a0Coca Cola had lost the case before the High Court, which\u00a0found that KRA was within the law\u00a0in demanding the contested amount. Aggrieved, the\u00a0multinational moved to the appellate\u00a0court.<\/p>\n<p>According to KRA, its audit revealed that a number of returnable containers used by Coca Cola subsidiaries in Kenya had their taxes not paid for.\u00a0KRA demanded Sh5.6 billion\u00a0on account of alleged arrears of excise duty and interests, while maintaining returnable containers (bottles and crates) were subject to taxes.<\/p>\n<p>But Court of Appeal Judges Wanjiru Karanja, Otieno Odek and Sankale ole Kantai disagreed with the taxman by finding that the law does not speak on whether firms should pay taxes on returnable containers.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Author: Kamau Muthoni\u00a0 AfricaPress-Kenya: The Supreme Court has dismissed an application to strike out a Sh5.6 billion tax suit filed by Kenya Revenue Authority (KRA) against international soft drinks manufacturer Coca Cola Company.
