{"id":15233,"date":"2020-10-01T18:48:19","date_gmt":"2020-10-01T18:48:19","guid":{"rendered":"https:\/\/www.africa-press.com\/kenya\/?p=15233"},"modified":"2020-10-01T18:48:19","modified_gmt":"2020-10-01T18:48:19","slug":"uhuru-could-earn-new-term-ag-says","status":"publish","type":"post","link":"https:\/\/www.africa-press.net\/kenya\/policy\/uhuru-could-earn-new-term-ag-says","title":{"rendered":"Uhuru could earn new term, AG says"},"content":{"rendered":"<p><strong>Authors:\u00a0PAUL OGEMBA AND KAMAU MUTHONI\u00a0<\/strong><br \/>\n<strong>AfricaPress-Kenya:<\/strong> President Uhuru Kenyatta may get a fresh or longer term in office if Chief Justice David Maraga\u2019s controversial\u00a0advisory that MPs\u00a0should be sent packing for not enacting the gender rule stands, the Attorney General has said.<\/p>\n<p>Attorney-General Kihara Kariuki\u2019s argument is contained in a court filing challenging Justice\u00a0Maraga\u2019s\u00a0landmark recommendation to dissolve Parliament before its term is complete.<\/p>\n<p>In his application that was submitted yesterday by Solicitor General Ken Ogeto, Mr Kihara\u00a0argues that the head of the\u00a0Judiciary is out of order, and it is his intention to cause harm to the country.<\/p>\n<p>\u201cIf Parliament commences a fresh term that falls out of the constitutional date for a General Election, the same will have the effect of altering the term of office of the president as, ordinarily, a presidential election may be held only on the same date as the General Election for MPs,\u201d he says.<\/p>\n<p>According to the AG, the\u00a0Constitution requires that Parliament\u00a0shall have a new term upon dissolution. If Uhuru abides by\u00a0Maraga\u2019s\u00a0advice, MPs who get re-elected will earn a fresh mandate of five years.<\/p>\n<p>\u201cSuch a term may run out of the constitutional date for the conduct of the General Election of MPs, which is held on the second Tuesday of August in every fifth year.\u201d<\/p>\n<p>The AG further argues that in the event the august House is dissolved, the Constitution is vague on whether there should be a General Election or by-election.<\/p>\n<p>The law is also unclear on the timelines within which an election arising from the dissolution of Parliament shall be held, he says. He also questions the CJ\u2019s timing, saying\u00a0that the Constitution does not set timelines for him to issue the advisory.<\/p>\n<p>Kihara says there is uncertainty whether MPs should serve a fresh five-year term or exit office in 2022. This, he adds, has a bearing on county officeholders.<\/p>\n<p>\u201cThe respondent\u2019s advice is incapable of implementation in light of transitional and facilitative legal frameworks. This is in addition to the economic, political and social difficulties that the said advice portends.<\/p>\n<p>\u201cThe respondent expressly admits to the profound ramifications of his Excellency the President heeding his advice but, nevertheless, issues the impugned advice on the logic that there is no pain without gain.<\/p>\n<p><strong>Cause harm<\/strong><\/p>\n<p>\u201cIn the present instance, however, the respondent breached his obligation by choosing a decision which causes the most harm to the Republic of Kenya.\u201d<\/p>\n<p>According to the AG,\u00a0Maraga\u2019s\u00a0interpretation of Article 261(6) of the Constitution is flawed.<\/p>\n<p>He argues that the provision requires the High Court to transmit its order to Parliament and the Attorney General before any other action starts.<\/p>\n<p>In his advisory dated September 21,\u00a0Maraga\u00a0accused Parliament of snubbing his orders that required an explanation on why the two-thirds gender rule has not been enacted to date.<\/p>\n<p>\u201cYour Excellency, the two-thirds gender rule is an acronym for the constitutional imperative which prohibits any form of discrimination in the elective and appointive positions on the basis of one gender. It is clearly\u00a0the radical remedy Kenyans desired to incentivise the political elites to adhere to and fully operationalise the transformational agenda of the Constitution they bequeathed themselves in 2010,\u201d he wrote.<\/p>\n<p>But Kihara, who was his colleague at the Court of Appeal, said the President has a right to\u00a0ignore the advisory.<\/p>\n<p>\u201cIt is the petitioner\u2019s view that the president\u2019s role has to be discretionary as he must be satisfied that Parliament has indeed not enacted the required legislation, or that Parliament has in fact not, since the Chief Justice\u2019s advice, moved to enact the legislation,\u201d he said.<\/p>\n<p>The AG is of the view that the Constitution does not contemplate a vacuum in Parliament where all lawmakers are sent home before their term ends.<\/p>\n<p><strong>No money<\/strong><\/p>\n<p>Meanwhile, the National Treasury has told the court there is no money to carry out an impromptu General Election.<\/p>\n<p>National Treasury Principal Secretary Julius Muia, in his supporting affidavit, says the Independent Electoral and Boundaries Commission would require Sh41 billion to conduct a fresh poll but the funds are not available.<\/p>\n<p>\u201cThe respondent disregarded the fact that the Covid-19 pandemic has been utterly disruptive, including economically.
