The petitioner, Francis Awino, argues that Wandayi&#8217;s continued tenure undermines public confidence and poses risks to safety and accountability in the petroleum sector, urging the court for urgent intervention.<\/p>\n<\/div>\n<p><span class=\"ap-article-header-tag\"> <strong>Africa-Press &#8211; Kenya. <\/strong> <\/span>constitutional petition has been filed at the High Court seeking the suspension of Opiyo Wandayi as Energy Cabinet Secretary over alleged irregular fuel importation.<\/p>\n<p>In the case, petitioner Francis Awino is seeking urgent conservatory orders to restrain Wandayi from continuing to exercise the powers and functions of the CS pending the hearing and determination of the petition.<\/p>\n<p>&#8220;That pending the hearing and determination of this Application inter partes, this Honourable Court be pleased to issue a conservatory order restraining the Respondent (Wandayi), whether by himself, his agents, servants or any person acting under his authority, from exercising the powers and functions of the office of Cabinet Secretary for Energy and Petroleu\u0301m,&#8221; the application states.<\/p>\n<p>The High Court has also been asked to certify the matter as urgent and to hear it ex parte in the first instance, citing what the petitioner describes as grave constitutional issues touching on public safety, leadership and integrity, and the management of the petroleum sector.<\/p>\n<p>The Attorney General and the Energy and Petroleum Regulatory Authority have been listed as interested parties in the case.<\/p>\n<p>According to court documents dated April 10, 2026, the petitioner argues that the continued stay in office of the Cabinet Secretary undermines public confidence and raises concerns about accountability and transparency in the management of a critical sector of the economy.<\/p>\n<p>The application is anchored on claims of what he describes as unlawful importation of petroleum products, which the petitioner says poses potential risks to public safety, consumer protection, and environmental standards if not urgently addressed by the court.<\/p>\n<p>Awino is seeking several conservatory orders, including the suspension of Wandayi from office or, in the alternative, orders restricting him from making decisions related to petroleum procurement, importation, licensing, and regulatory approvals until the case is heard and determined.<\/p>\n<p>He also wants the court to compel the CS to surrender authority over ongoing petroleum importation processes to a neutral and lawful mechanism under the supervision of the Energy and Petroleum Regulatory Authority or any other body the court may direct.<\/p>\n<p>&#8220;That following public outcry, several public officers were arrested and investigations commenced&#8230;and that I am aware that certain senior officials resigned thereby underscoring the gravity of the matter,&#8221; he states in his court documents.<\/p>\n<p>Awino further argues that the matter raises weighty constitutional questions under Chapter Six of the Constitution on leadership and integrity, and that the court has jurisdiction under Articles 23 and 165 to grant conservatory orders to protect fundamental rights and uphold constitutional principles.<\/p>\n<p>Awino also claims he has faced threats, intimidation, and physical violence for pursuing the matter, and is seeking protective intervention from the court to safeguard his constitutional rights.<\/p>\n<p>&#8220;That I am advised by my advocates on record, which advice I verily believe to be true, that I have established a prima facie case, with a high probability of success,&#8221; he says.<\/p>\n<p>Additionally, he states that public interest heavily favours urgent court intervention, citing the sensitivity of the sector.<\/p>\n<p>The court is expected to give further directions.<\/p>\n<p>The issue of fuel importation in Kenya has been a contentious topic, often linked to broader concerns about governance and accountability in the energy sector.
