Africa-Press – Kenya. <\/strong> <\/span>The Senate Standing Committee on Finance and Budget has intervened after the National Treasury halted funds transfers to Meru County, raising concerns over possible salary delays and disruption of essential services in the county.<\/p>\n

Lawmakers raised concerns over the impact of the unprecedented freeze on critical services, including healthcare and water provision.<\/p>\n

They also warned that the move could affect the county\u2019s ability to pay staff salaries, raising the risk of a liquidity crisis.<\/p>\n

The senators are planning to conduct a comprehensive inquiry before a final report is tabled in Parliament.<\/p>\n

To this end, the committee has summoned Treasury Cabinet Secretary John Mbadi, Governor Isaac Mutuma, the Controller of Budget and the Auditor General.<\/p>\n

\u201cWe must proceed by first inviting the National Treasury, the County Government of Meru, the Controller of Budget and the Auditor General,\u201d said Ali Roba, committee chairperson and Mandera Senator.<\/p>\n

The summons follows the Treasury\u2019s move to stop up to 50 per cent of the equitable share funds allocated to Meru, effective from April 10.<\/p>\n

Mbadi invoked Article 225 of the Constitution in the decision, citing a persistent material breach by the county.<\/p>\n

The breach involves failure by the county to settle a court-awarded debt owed to a foreign investor.<\/p>\n

The award, initially valued at Ksh339 million, has grown significantly due to an annual interest rate of 14 per cent, making it nearly unmanageable as it rivals the county\u2019s total pending bills.<\/p>\n

Lawmakers acknowledged the legal obligation to honour debts and international implications. However, they questioned the proportionality of the decision, with some describing the suspension of funds as excessive.<\/p>\n

Senators expressed alarm over the precedent the decision could set for the other 46 counties, warning it may encourage investors to pursue drastic interventions capable of paralysing local governments.<\/p>\n

The committee noted that the Treasury\u2019s decision will lapse on May 10 unless both Houses of Parliament approve it.<\/p>\n

\u201cIf the decision is not approved within 30 days, it will be deemed never to have taken place, and any retained funds must be released immediately,\u201d explained Mombasa Senator Mohamed Faki.<\/p>\n

The financial management of counties in Kenya has been a contentious issue, particularly regarding the equitable share of funds from the National Treasury. The Constitution mandates that counties receive funds to ensure they can provide essential services to their residents.
