Africa-Press<\/a> – Kenya<\/a>. <\/strong><\/span>Transport CAS Wavinya Ndeti was caught up in a fight for the ownership of a piece of land valued at Ksh400 million at Athi River.<\/p>\n

According to court documents, trader Abdinoor Shariff accused Wavinya and another relative of colluding with the National Land Commission to acquire the land.<\/p>\n

Shariff has now moved to the Court of Appeal after the High Court declined to award the land to any of the parties.<\/p>\n

The trader told the court that the NLC left him out of a hearing to determine the 5-acre land\u2019s owner before awarding it to Wavinya\u2019s relative Peter Nzuki Ndeti.<\/p>\n

Shariff is also seeking compensation from NLC to the tune of Ksh197 million for part of the land which is set to be acquired by the government for the expansion of the Athi River – Machakos Highway.<\/p>\n

Ahmed argued that he bought the land in 2004 and did not receive any complaints about its ownership.<\/p>\n

NLC defended that it had awarded Nzuki the land after he claimed to have occupied the land since 1960 alongside Elizabeth Nzili Ndeti<\/p>\n

Nzuki filed a complaint in 2016 claiming that Shariff had irregularly acquired the land during a time when Kenya National Highways Authority was on the verge of disbursing Ksh197 million to acquire a part of the land.<\/p>\n

In a similar land case, Nzuki filed a complaint against a transport company, Dakawou in 2017, which he accused of acquiring his piece of land.<\/p>\n

Represented by Wavinya Ndeti\u2019s brother, Raphael Ndeti, the family won a case at the land courts in Machakos but the transport company moved to the Court of Appeal.<\/p>\n

According to court papers, it was only after the land was selected by the government for acquisition in 2017, that the owner saw the family file a 22-year-old claim on the land.<\/p>\n

The Ksh89 million property was supposed to be set aside for the construction of the Standard Gauge Railway.<\/p>\n","protected":false},"excerpt":{"rendered":"
