Africa-Press – Kenya. <\/strong><\/span>Deputy president-elect Rigathi Gachagua and Nyeri governor Mutahi Kahiga will not testify in the inquest investigating the circumstances that led to the death of the second Nyeri governor Wahome Gakuru.<\/p>\n

This is after the High Court in Nyeri quashed the orders made by chief magistrate Wendy Kagendo on August 21, 2021, and chief magistrate Francis Andayi on January 20, this year.<\/p>\n

The courts had made orders summoning the two to give evidence in the inquest investigating circumstances that led to the death of the late governor.<\/p>\n

Judge Florence Muchemi while making the ruling said Kahiga was the deputy governor at that time and succeeded the governor after the accident and he said he learnt about the accident from other people in the morning.<\/p>\n

Kahiga, she said, said he knew nothing else about the circumstances surrounding the incident.<\/p>\n

She said the court considered the arguments of the lawyers in the two applications and also the prosecuting counsel during the inquest and the lawyers for the respondents before making its decision.<\/p>\n

\u201cThe court noted that it is correct that 17 witnesses had been summoned and the prosecutor had indicated that only one was remaining,\u201d she said.<\/p>\n

From the submission of the prosecuting counsel, she said, the court noted that the evidence of the applicants was communicated to the court about the position of the prosecution on their evidence which they said had no probative value.<\/p>\n

\u201cThe courts chose to grant the request of the victims\u2019 advocate without examining the value that the statements would add to that inquest,\u201d she read.<\/p>\n

\u201cI have looked briefly at the statements of the applicants and I agree with the respondent in this application that the statements have no probative value. The summoning of the applicants to court to testify in the inquest will not serve any purpose in my considered view\u201d<\/p>\n

The judge termed the summons issued as irregular and said the magistrate should not have rejected the objections raised by the counsel against the issuance of the summons for the applicants to attend the court and testify in the inquest.<\/p>\n

Gahagua and Kahiga had argued that the summons by the chief magistrates had no basis as they had no evidence to give in the inquest.<\/p>\n

They also claimed that no one had mentioned them adversely and that the court had not made any finding that anyone had been found to have committed an offence in the inquest.<\/p>\n

The judge as a result referred the inquest back to the chief magistrate court for the remaining witness who was the investigating officer to give evidence so that the inquest can be closed.<\/p>\n

The matter will be mentioned on September 1, before the chief magistrate court in Nyeri.<\/p>\n

Their lawyer Wahome Gikonyo while addressing the media after the ruling said there was no basis for summoning them because the application to summon them was made by a lawyer from the bar.<\/p>\n

\u201cThat is the lawyer watching brief for Thamana Afria. And it really surprised me that such an application could be made and allowed because the law is clear on the circumstances under which somebody who had not recorded a statement with the police when they were collecting evidence could be summoned on the basis of a lawyer and not on the basis of the court\u2019s own finding that this person needs to come and give evidence,\u201d he said.<\/p>\n

Gakuru died at Thika Level 5 hospital on 7 November 2017, after a road accident at Kabati near Kenol along Thika road.<\/p>\n
