Africa-Press – Kenya. <\/strong><\/span>A Machakos Court has dismissed a case involving a supplier who claimed he had not received payment for delivered goods.<\/p>\n

Chief Magistrate E H Keago said the supplier lacked evidence to back his claim, adding that the school had payment evidence.<\/p>\n

“The upshot of this is that the defendant is the successful party in this case and therefore awarded costs. Rights of Appeal within 30 days,” the court said.<\/p>\n

In the case filed, East Kenya Supplies and Spares claimed that it supplied goods to Mbooni Boys High School and never received the payment.<\/p>\n

He said the school owed him Sh1,450,445.<\/p>\n

The supplier had alleged that the school had a pending payment of Sh1,392,595 for supplies between 2016 and 2017.<\/p>\n

East Kenya and Mbooni Boys had been in business from 2014 to 2018.<\/p>\n

Upon cross-examination, the supplier revealed that his claim was for the period from September 2017.<\/p>\n

He said he had received Sh65,820 for the invoice dated September 9, 2017.<\/p>\n

He was also paid Sh417,411 on September 12 and Sh400,000 for January 2017.<\/p>\n

The School Principal, who was a defendant in the case, said he had contracted the supplier for the goods on September 4.<\/p>\n

He produced evidence of payments amounting to Sh417,411 on September 30,2017, Sh400,000 on October 10,2017 and Sh390,385 on March 21,2018.<\/p>\n

The school also paid Sh26,060 on September 14, 2018.<\/p>\n

The principal further said there had been irregularities in the Local Purchase Orders (LPO) from before his time.<\/p>\n

He however gave evidence that the school board had settled all bills.<\/p>\n

There were four cheques for payments of January 2017 supplies totalling Sh800,000.<\/p>\n

The Court further said the supplier had failed to be clear in his claims.<\/p>\n

“The plaintiff in his testimony as not clear whether his claim was based on the LOP issued on September 4 or it included a pending bill for 2017 and 2016,” the court said.<\/p>\n

It added:<\/p>\n

“The pleadings were not very specific and therefore there was no specific evidence lead on how the plaintiff came up with the pleaded amount.”<\/p>\n
