Africa-Press – Kenya. <\/strong><\/span>The recent actions taken by the ousted FKF President Nick Mwendwa have set dangerous precedence against our country\u2019s legal system, seasoned football administrator, Twaha Mbarak has said.<\/p>\n

His remarks come barely days after Mwendwa stormed the FKF offices at Goal Project in Kasarani, claiming he had regained control of football leadership.<\/p>\n

Mbarak said Mwendwa’s actions were likely to taint the country’s good standing in the world of football.<\/p>\n

\u201cKenyans and mostly football stakeholders must now join hands to protect and rescue the image of Kandanda House from a man who believes he is above the law,\u201d Mbarak claimed.<\/p>\n

The FKF presidential aspirant took a swipe at Mwendwa for continuing to misinterpret the statutes of the world football governing body, Fifa.<\/p>\n

\u201cHe has also undermined Kenya’s constitution at will for his benefit. It\u2019s high time he is compelled to submit to the rule of law like any other Kenyan failure to which precedence shall be set where a state officer will steal public money and use the same to avoid justice by circumventing the justice system.\u201d<\/p>\n

He added: \u201cIt is ridiculous that he refuses to take a plea. If he believes that he is innocent, why can\u2019t he table his evidence to clear his name in a court of law? Why is he deceiving Kenyans that he has no case to answer and even goes as far as attempting to block prosecution? Mwendwa should know that Kenya has a scarcity of fools.\u201d<\/p>\n

Twaha sighted Article 13(3) of the Fifa Code of Ethics which says:<\/p>\n

\u201cPersons bound by this Code shall appreciate the impact their conduct may have on Fifa\u2019s reputation, and shall therefore behave in a dignified and ethical manner and act with complete credibility and integrity at all times.\u201d<\/p>\n

He added: \u201cPersons bound by this Code shall not misappropriate or misuse funds of Fifa, the confederations, associations, leagues or clubs, whether directly or indirectly through, or in conjunction with, third parties,” the article states.<\/p>\n

\u201cFrom the above statutes, Mwendwa has to know that no man is above the law and everyone \u2014 whatever the rank or position \u2014 is subject to the laws of the land,\u201d Mbarak noted.<\/p>\n
