Africa-Press – Kenya. <\/strong><\/span>Drama erupted in Malindi court on Wednesday when a man facing fraud charges started shouting terming the court the most useless in the world.<\/p>\n

Carlos Taka, 68, is charged with six counts of obtaining money by false pretense and impersonating a public officer.<\/p>\n

His protest was prompted by a decision by the magistrate to adjourn his case for the umpteenth time.<\/p>\n

“I have spent more than one year in remand just because some witnesses failed to to testify. This is the most useless court in the world,” he said, pointing out that justice delayed is justice denied.<\/p>\n

Efforts by Malindi Resident Magistrate Olga Onalo to calm him down fell on deaf ears as Taka went on shouting angrily, arousing laughter from the packed courtroom.<\/p>\n

Taka wondered why his case had taken so long to be concluded yet witnesses live nearby the court.<\/p>\n

He said one witness stays behind the law courts while another lives at Kwa Ndomo area, a short distance from the court.<\/p>\n

Earlier, the accused person had cross-examined one witness and was expecting other witnesses to testify only to hear that there was no other witness present.<\/p>\n

The Magistrate adjourned the hearing saying it was the last adjournment and directed the prosecution to produce the witness in court.<\/p>\n

The magistrate set the hearing date on December 14.<\/p>\n

Taka was charged that on September 21, 2021 he obtained Sh3,500 from Mary Masia with intent to defraud by falsely pretending that he was in a position to employ her at Malindi International Airport as an office messenger, a fact he knew to be false.<\/p>\n

The charge sheet said the offence happened at the Malindi old Court in Malindi subounty within Kilifi county.<\/p>\n

The charges state that Taka also obtained Sh6,500 from Jacqueline Santa Thoya between June 12, 2021 and June 20, 2021 at Gede area by falsely pretending that he was in a position to employ her at Mercy USA NGO as a field officer.<\/p>\n

He faces four other counts of similar nature.<\/p>\n

The 68-year-old is also accused of impersonating a public officer contrary to section 105 (a) of the penal code.<\/p>\n

He is accused that on September 21, 2021 at Malindi Old Court, he falsely presented himself as one employed in the Public Service to Mary Masisa.<\/p>\n

Taka told the complainant that he is the head of the Presidential Delivery Unit in monitoring drought situation in Kilifi and took registration fee of Sh1,000 from her.<\/p>\n
