Also acquitted are former company secretary Gloria Khafafa, Vincent Korir Cheruiyot GM supply chain,Nicholas Gitobu procurement manager,Billy Aseka GM infrastructure and Samuel Odoyo GM Finance. Magistrate Victor Wakumile has ruled that the offense they were charged with jointly was ‘fatally defective’ and he dismissed it.<\/p>\n

He noted that the said project had been in the plans of KPC and most witnesses including the board chair John Ngumi had confirmed that the project was implemented in 2006 way before most of the accused joined the company.<\/p>\n

\u201cThe entire case against all accused collapses under section 215 they are now all acquitted,\u201d Wakumile ruled.<\/p>\n

After reading the judgment sang, Khafafa and Korir were overcome by emotions. They were charged in 2019. Wakumile encouraged them not to cry \u201cSang don\u2019t cry.\u201d<\/p>\n

The court wondered why the accused were even charged in the first place saying Khafafa should have been a witness not an accused. “I note that the accused have lost time and resources in their quest for freedom but unfortunately, that is life sometimes.”<\/p>\n

\u201cI hope we never meet again in this circumstances\u201dWakumile said<\/p>\n
