Africa-Press – Kenya. <\/strong><\/span>The Senate\u2019s leadership will be put to test during the expected debate on the impeachment of Meru Governor Kawira Mwangaza.<\/p>\n

The independently elected governor was impeached on Wednesday after 67 out of 69 MCAs of Meru voted to send her home.<\/p>\n

The impeachment motion was tabled by Abogeta West MCA DMK Kiogora and the minority whip.<\/p>\n

The MCAs wanted her out of office over alleged gross misconduct, the appointment of her husband to the county office and claims over the dismissal of county officers.<\/p>\n

The impeachment came less than 14 days after President William Ruto and his Deputy Rigathi Gachagua gave their assurance that they will hold a meeting with Meru leadership to assess the situation.<\/p>\n

The presidency had called on Meru leaders to unite and rally behind Mwangaza, with Ruto pledging to support her all through.<\/p>\n

However, with Ruto in the US, the Meru county assembly went ahead and impeached their 112-day-old governor.<\/p>\n

Following impeachment, the law states that the county assembly should notify the Senate within two days.<\/p>\n

Section 33 of the County Government Acts states, \u201cIf a motion is supported by at least two-thirds of all the members of the county assembly, the speaker of the county assembly shall inform the Speaker of the Senate of that resolution within two days.\u201d<\/p>\n

During this period, Governor Mwangaza will continue to perform the functions of the office pending the outcome of the proceeding as the law indicates.<\/p>\n

Within seven days after receiving notice of a resolution from the speaker of the county assembly, Senate Speaker Amason Kingi is expected to convene a sitting to hear the charges against the governor.<\/p>\n

As anchored in the county government act, the Senate will vote to have the governor face the whole house or a special committee on her impeachment.<\/p>\n

The governor shall have the right to appear and be represented before the special committee during its investigations or the whole house.<\/p>\n

The Senate will then vote to either uphold or overturn the impeachment.<\/p>\n

The third Senate was put to the test during heated debates on the impeachment of governors.<\/p>\n

The House considered five impeachment motions.<\/p>\n

Three of the impeachment processes that were considered by way of an investigation by a Special Committee include the one on former Taita Taveta governor Granton Samboja in 2019, Anne Waiguru (Kirinyaga) in 2020 and Wajir\u2019s Mohamed Abdi Mohamud in 2021.<\/p>\n

The impeachment of Kiambu Governor Ferdinand (2020) and his Nairobi counterpart Mike Mbuvi Sonko(2020) were, however, considered in plenary.<\/p>\n

The Senate overturned Samboja and Waiguru\u2019s impeachment while Mohamud, Sonko and Waititu were sent home.<\/p>\n

Currently, the Senate is on long recess and is meant to resume sittings in February 2023.<\/p>\n

Eyes are now on Speaker Kingi whether or not he will recall the house to consider Governor Mwangaza\u2019s impeachment, whose fate lies in the Senate.<\/p>\n
